Book Beyond the Formalist Realist Divide

Download or read book Beyond the Formalist Realist Divide written by Brian Z. Tamanaha and published by Princeton University Press. This book was released on 2009-10-26 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: According to conventional wisdom in American legal culture, the 1870s to 1920s was the age of legal formalism, when judges believed that the law was autonomous and logically ordered, and that they mechanically deduced right answers in cases. In the 1920s and 1930s, the story continues, the legal realists discredited this view by demonstrating that the law is marked by gaps and contradictions, arguing that judges construct legal justifications to support desired outcomes. This often-repeated historical account is virtually taken for granted today, and continues to shape understandings about judging. In this groundbreaking book, esteemed legal theorist Brian Tamanaha thoroughly debunks the formalist-realist divide. Drawing from extensive research into the writings of judges and scholars, Tamanaha shows how, over the past century and a half, jurists have regularly expressed a balanced view of judging that acknowledges the limitations of law and of judges, yet recognizes that judges can and do render rule-bound decisions. He reveals how the story about the formalist age was an invention of politically motivated critics of the courts, and how it has led to significant misunderstandings about legal realism. Beyond the Formalist-Realist Divide traces how this false tale has distorted studies of judging by political scientists and debates among legal theorists. Recovering a balanced realism about judging, this book fundamentally rewrites legal history and offers a fresh perspective for theorists, judges, and practitioners of law.

Available in PDF, EPUB and Kindle. Book excerpt: Many of the foundational truths of Christianity have been lost or distorted by those who have erroneously taken the Holy Scriptures out of context to often make them say something different from their original intent. As a result, the church of our Lord and Savior Jesus Christ has split and splintered in every possible direction, and many are confused by what is currently presented to them as Christianity. The major purpose of this book is to bring clarity to many of the lost or misunderstood teachings that were clearly understood by the first-century church. The Holy Spirit gave the revelation to the first-century apostles, and He has again raised up apostles in the twenty-first-century to bring restoration and renewal to the church that Jesus Christ died for. Let's rediscover these basic but powerful truths together.

Book The Metaphysics of Beauty

Download or read book The Metaphysics of Beauty written by Nick Zangwill and published by Cornell University Press. This book was released on 2018-05-31 with total page 239 pages. Available in PDF, EPUB and Kindle. Book excerpt: In chapters ranging from "The Beautiful, the Dainty, and the Dumpy" to "Skin-deep or In the Eye of the Beholder?" Nick Zangwill investigates the nature of beauty as we conceive it, and as it is in itself. The notion of beauty is currently attracting increased interest, particularly in philosophical aesthetics and in discussions of our experiences and judgments about art. In The Metaphysics of Beauty, Zangwill argues that it is essential to beauty that it depends on the ordinary features of things. He uses this principle to defend the notion of the aesthetic, to call for a version of aesthetic formalism, and to reconsider the reality of beauty. The Metaphysics of Beauty brings beauty to the center of intellectual consciousness in a manner informed by contemporary metaphysics and engages with beauty as an enduring object of human thought and experience.

Book excerpt: Polarized light is a pervasive influence in our world—and scientists and engineers in a variety of fields require the tools to understand, measure, and apply it to their advantage. Offering an in-depth examination of the subject and a description of its applications, Polarized Light, Third Edition serves as a comprehensive self-study tool complete with an extensive mathematical analysis of the Mueller matrix and coverage of Maxwell’s equations. Links Historical Developments to Current Applications and Future Innovations This book starts with a general description of light and continues with a complete exploration of polarized light, including how it is produced and its practical applications. The author incorporates basic topics, such as polarization by refraction and reflection, polarization elements, anisotropic materials, polarization formalisms (Mueller–Stokes and Jones) and associated mathematics, and polarimetry, or the science of polarization measurement. New to the Third Edition: A new introductory chapter Chapters on: polarized light in nature, and form birefringence A review of the history of polarized light, and a chapter on the interference laws of Fresnel and Arago—both completely re-written A new appendix on conventions used in polarized light New graphics, and black-and-white photos and color plates Divided into four parts, this book covers the fundamental concepts and theoretical framework of polarized light. Next, it thoroughly explores the science of polarimetry, followed by discussion of polarized light applications. The author concludes by discussing how our polarized light framework is applied to physics concepts, such as accelerating charges and quantum systems.
