Book excerpt: The War on Terror has been going on for over a decade and it shows no signs of winding down in near future, a war which has directly contributed to growing security regimes in frontline states. This book focuses on the legal dimensions of the War on Terror and security in Pakistan. It highlights the growth of the security state in Pakistan, and questions the growing and by-now entrenched legal security regime in the country. The book traces the roots of the present security laws in colonial and post-colonial times. One broader dimension from which the legal security regime of Pakistan is approached in this book is through highlighting specific issues concerning the legal identity of the subject such as the rights of aliens in the background of state power versus liberal constitutionalism, and the rights of terrorism suspects in the background of deploying death sentence as a tactical, psychological tool versus the absolute right to life (of every individual). By critically reflecting on the increasingly institutionalized form of the security apparatus in Pakistan, the book (indirectly) suggests the legal ways to resist the growing legal security regime and derogation from human rights. Offering a theoretically engaged and critically reflective overview of the current state of individual identity, rights and freedoms in face of a burgeoning legal regime of security in Pakistan, this study makes advances in critical legal studies and critical IR. It will be of interest to academics working in the field of security studies, South Asian Studies, particularly Pakistan, and the War on Terror.

And what explains how Pakistanis think? Much of the current work on extremism in Pakistan tends to study extremist trends in the country from a detached position—a top-down security perspective, that renders a one-dimensional picture of what is at its heart a complex, richly textured country of 200 million people. In this book, using rigorous analysis of survey data, in-depth interviews in schools and universities in Pakistan, historical narrative reporting, and her own intuitive understanding of the country, Madiha Afzal gives the full picture of Pakistan’s relationship with extremism. The author lays out Pakistanis’ own views on terrorist groups, on jihad, on religious minorities and non-Muslims, on America, and on their place in the world. The views are not radical at first glance, but are riddled with conspiracy theories. Afzal explains how the two pillars that define the Pakistani state—Islam and a paranoia about India—have led to a regressive form of Islamization in Pakistan’s narratives, laws, and curricula. These, in turn, have shaped its citizens’ attitudes. Afzal traces this outlook to Pakistan’s unique and tortured birth. She examines the rhetoric and the strategic actions of three actors in Pakistani politics—the military, the civilian governments, and the Islamist parties—and their relationships with militant groups. She shows how regressive Pakistani laws instituted in the 1980s worsened citizen attitudes and led to vigilante and mob violence. The author also explains that the educational regime has become a vital element in shaping citizens’ thinking. How many years one attends school, whether the school is public, private, or a madrassa, and what curricula is followed all affect Pakistanis’ attitudes about terrorism and the rest of the world. In the end, Afzal suggests how this beleaguered nation—one with seemingly insurmountable problems in governance and education—can change course.

It offers a local perspective on peace and conflict resolution in Pakistan's Pashtun 'tribal' region. Discussing the history and background of the former-FATA region, the role of Pashtun conflict resolution mechanism of Jirga, and the persistence of colonial-era Frontier Crimes Regulations (FCR) in the region, the author argues that the persistence of colonial legacies in the Pashtun 'tribal' areas, especially the FCR, coupled with the overarching influence of the military on security policy has negatively impacted the security situation in the region. By focusing on the Jirga and Jirga-based Lashkars (or Pashtun militias), the book demonstrates how Pashtuns have engaged in their own initiatives to handle the rise of militancy in their region. Moreover, the book contends that, even after the introduction of constitutional reforms and FATA's merger with the Khyber Pakhtunkhwa province, little has changed in the region, especially regarding the treatment of 'tribal' Pashtuns as equal citizens of Pakistan. This book explains, in detail, why indigenous methods of peace and conflict resolution, such as the Jirga, could play "some" role towards long-term peace in the South Asian region. Book excerpt: This PhD thesis explores the paradox whereby the Pakistani state has emphasised improving its national security but has done so in a way that has increasingly led to greater insecurity in the country in the post-Cold War era. The thesis identifies the limitations of Pakistan’s military-centred national security approach, in which its military has consistently held a dominant position in policy-making and which has led to a worsening security situation. Since the inception of the Pakistani state in 1947, the perceived threat to national survival has enabled the military to build its own economic empire, command a disproportionate share of Pakistani government expenditure, and largely escape civilian control in shaping the national security policies of the country. However, the interests of Pakistan’s military-industrial complex have been increasingly challenged by a post-Cold War transformation of the regional and international security environment, particularly after the 9/11 terror attacks. Pakistan has gone from a country that at the time of independence was more worried about external security threats to one where internal security threats from home-grown terrorism and repercussions from Pakistan’s covert involvement in neighbouring external conflicts, have compounded its security problems. Nevertheless, despite the changing and worsening security problems, Islamabad has continued to prioritize military competition with India and intervention in Afghanistan. The thesis argues that the mismatch between Pakistan’s military-centric approach to national security and a transformed security environment has been facilitated and sustained by the embedded and parasitic interests of the country’s military-industrial complex
