Book excerpt: Developments over the past 25 years in school-related legal issues in elementary schools have significantly changed the principal's role. In 1975, a decision of the U.S. Supreme Court established three due-process guidelines for short-term suspension. The decision requires student notification of charges, explanation of evidence, and an informal hearing. Principals should create a written discipline code incorporating these elements and any applicable state laws. In the area of corporal punishment, the Supreme Court has examined both constitutional issues--cruel and unusual punishment--and due process, and tort law. And while corporal punishment is constitutionally permitted with certain restrictions, even following applicable laws and guidelines does not eliminate the possibility of litigation arising from its use. Negligence torts and intentional torts are the two most common forms of tort liability experienced by principals. Safeguards against such tort cases can include effective supervision of school activities, inservice sessions on supervision for teachers, supervisory staff monitoring, and routine safety checks of equipment and facilities. Principals should also be concerned about legal issues in a relatively new area, special education. The changing characteristics of the family also present legal problems in the areas of student records and custody issues. (Contains 13 references.) (JPT)

He anticipates the likely state and nationwide impact of the Hawaii Supreme Court's decision. Mark Strasser examines the issue of same-sex marriage in light of contemporary constitutional and domestic relations law, showing why the usual arguments against recognizing such unions are either weak or irrelevant. The Supreme Court has articulated numerous interests promoted by marriage, all of which apply to same-sex as well as opposite-sex couples. According to Strasser, the argument made most frequently to deny recognition to same-sex unions—that marriage exists to provide a setting for the production and raising of children—is in fact a reason to acknowledge such unions. The claim that marriage is for children biologically related to both parents is refuted in the case law, which treats biological and adopted children as legally indistinguishable. Strasser explains Baehr v. Lewin, the precedent setting case in Hawaii, and addresses the implications of state-by-state decisions to ban or recognize same-sex unions. He analyzes what it would mean to say that a policy violates the Equal Protection or Due Process Clauses of the Constitution, and compares biased polices that target gays and lesbians with those that victimize racial minorities. Strasser argues that the Defense of Marriage Act (DOMA) is both unconstitutional and a public policy disaster. It does not give states additional rights with respect to which marriages they need not recognize, Strasser explains, but only with respect which divorces they need not recognize. For example, DOMA seems to allow an individual to avoid a court-imposed duty to support an ex-spouse of the same sex simply by changing his or her domicile. Moreover, Strasser argues, DOMA is an open invitation for states to demand exceptions that will wreak havoc in domestic relations law. In a recent response to conservative arguments about marriage, Legally Wed explicates established and involving legal principles, and shows how invidiously these have been applied to the issues of gay rights in general and same-sex unions in particular.

Book excerpt: Using an analysis of imperialism and case studies of Syria, Iran, Iraq, Bosnia, Russia and Ukraine, Global Democracy and the Crisis of Anti-Imperialism shows that the purported anti-imperialism of many self-professed socialists amounts to explicit or implicit support for totalitarianism, fascism, Islamist theocracy and imperialism. The analysis shows that the Russian revolution was followed by a counter-revolution, and resulted in state capitalism and the revival of Russian imperialism under cover of the Soviet Union. Thus the Cold War was actually a prolonged period of inter-imperialist rivalry between the United States and Russia. A large section of socialists who call themselves anti-imperialists oppose only Western imperialism and the despots it supports, not Russian imperialism and despots like Bashar al-Assad who are supported by it. As Russia has moved further and further to the right under Putin, they have effectively defected to the far right. They and other socialists also mistakenly believe that political democracy is organically connected to capitalism and therefore need not be defended, whereas, on the contrary, democracy is only established by mass struggles, and is an indispensable resource in the fight against exploitation and oppression. Finally, these socialists fail to understand that without internationalism, it is impossible to defeat global capitalism and its neoliberal policies. All the case studies in this book represent attempts to carry out democratic revolutions, which are supported by genuine socialist internationalists but opposed by pseudo-anti-imperialists. The book ends by suggesting steps that can be taken to promote democracy and end mass slaughter.
