Book excerpt: This study contributes to the work stream on digital sequence information of FAO’s Commission on Genetic Resources for Food and Agriculture (GRFA). It presents key practices and experiences related to the ways in which digital sequence information (DSI) is generated, stored, accessed, and used for research and development related to GRFA. The report explores the availability and accessibility of DSI to the research community and the private sector in all parts of the world. It also presents solutions currently being discussed for access to, and use of, DSI and the sharing of benefits arising from such use. In addition, the study discusses applications of DSI that are relevant to GRFA, including DSI that is not derived from GRFA but nevertheless contributes to their identification, characterization, use, improvement and conservation. Further, the report addresses obstacles to access and use of DSI and identifies the need for capacity building to address global imbalance in its generation and use.The study demonstrates the many existing and potential applications of DSI that are highly relevant to GRFA whilst stressing the importance of open access to data to facilitate research and development in food and agriculture. It emphasises that the generation, storage, accessibility and use of DSI are fundamental to the efforts to make agriculture more sustainable. Access to, and use of, DSI face serious obstacles in many countries. There is a pressing need to address the root causes of these problems, which include lack of: technical infrastructure, financial and human resources, educational and training opportunities, scientific collaboration, computing infrastructure, reliable electricity and high-speed internet. The study concludes that there is a need for a regulatory environment that facilitates access to DSI whilst also maintaining the fair and equitable sharing of benefits arising from its use.

The Convention on Biological Diversity refers to this type of data as “Digital Sequence Information (DSI)”. Innovation in different domains and subsectors, ranging from agriculture and biodiversity conservation, to biotechnology and human health, depends on the use of DSI. Access to DSI and related technologies is crucial for any stakeholder and country, in order to reach long term food security objectives, to be able to adapt to climate change, to deal with human health issues, and to contribute to the conservation and sustainable use of biodiversity. Stakeholder consultations in the Netherlands indicate that fair and equitable benefit sharing arrangements - related to the use of DSI - should possibly only be dealt with in a multilateral context.

As crops have moved around the world, and agricultural innovation and production systems have expanded, so too has the scope and coverage of pools of shared plant genetic resources that support those systems. The range of actors involved in their conservation and use has also increased dramatically. This book addresses how the collective pooling and management of shared plant genetic resources for food and agriculture can be supported through laws regulating access to genetic resources and the sharing of benefits arising from their use. Since the most important recent development in the field has been the creation of the multilateral system of access and benefit-sharing under the International Treaty on Plant Genetic Resources for Food and Agriculture, many of the chapters in this book will focus on the architecture and functioning of that system. The book analyzes tensions that are threatening to undermine the potential of access and benefit-sharing laws to support the collective pooling of plant genetic resources, and identifies opportunities to address those tensions in ways that could increase the scope, utility and sustainability of the global crop commons.

The continued proliferation of benefit-sharing clauses can be explained by their appeal as an optimistic frame in addressing sustainability and equity concerns related to bio-based innovation, the use of natural resources, environmental protection, and knowledge creation. In principle, fair and equitable benefit-sharing serves to recognize, encourage, and incentivise sustainable human relationships with the environment by focusing on equity issues arising from the most intractable challenges of our time, such as loss of biodiversity, climate change, poverty, and global epidemics. Empirical evidence, however, indicates that, in practice, benefit-sharing rarely achieves its fairness and equity objectives, and ends up entrenching or worsening inequitable relationships with little to no benefit for the environment. Instead of focusing on fair and equitable benefit-sharing in sub-specialist areas of international law in isolation, Elisa Morgera assesses the phenomenon from a general international law perspective and through comparison-across international environmental law, international human rights law, international health law, and the law of the sea. Strengthened by insights from local-level case studies in different regions and sectors, this book looks toward overcoming the limitations inherent in individual international regimes and addressing the shortcomings in benefit-sharing implementation. The discussion on conservation of plant genetic resources for food and agriculture (PGRFA), however, has to reflect the costs of conservation as well. These have not yet been discussed intensively. The study analyzes the conservation costs of plant genetic resources; it also assesses the effectiveness of conservation and the efficiency of the different conservation instruments. It is based on extensive surveys in relevant countries. Following the detailed cost and impact analysis, the results show that the effectiveness of conservation strategies may be increased.
