Book excerpt: The world is currently going through an unprecedented era of migration, with tens of millions of people moving to new cities, countries and continents every year. But though the decision to move can be driven by the search for opportunities and a better life, in many cases violence, persecution and other human rights abuses are the primary causes of migration. This is especially the case for minorities and indigenous peoples, who in the context of widespread discrimination can face a distinct experience of migration where their own agency is severely curtailed – one often characterized by further discrimination as entrenched patterns of exclusion are replicated elsewhere. This report, No escape from discrimination: minorities, indigenous peoples and the crisis of displacement, focuses specifically on the situation of minorities and indigenous peoples subjected to this form of forced migration, including its causes, impacts and potential solutions. Though the most direct and visible examples arise from the mass displacement of particular ethnic or religious communities due to sectarian violence, migration of minorities and indigenous peoples can also result from broader factors such as natural disasters or exclusion. In particular, the report focuses on four key areas - conflict, climate change, nationalism and land rights - where forced displacement among minority and indigenous communities is playing a decisive role in their ability to enjoy their most fundamental human rights. The report, while calling for a number of positive steps to protect vulnerable communities and provide the means for safe return or resettlement elsewhere, also highlights how displacement is generally the culmination of a protracted process of exclusion that leaves minorities and indigenous peoples particularly vulnerable to eviction, ethnic cleansing and other abuses. Establishing stronger rights protections for all, including minorities and indigenous peoples, rather than building walls or restricting travel, is therefore the only effective way to respond to the reality of displacement and provide a long-term solution to the crisis currently unfolding for these groups.

Book excerpt: In the year that saw the establishment of UN Women, the new United Nations entity for gender equality and women’s empowerment, minority and indigenous women continued to face violence, discrimination and marginalization, stemming both from their identity as women and as members of disadvantaged minority groups. In Latin America, despite the election of women as heads of state in several countries, African descendant and indigenous women remain virtually invisible in public and political life. They are also the population group that has borne the brunt of armed conflict in the region, subjected to rape and sexual violence. As elsewhere, they have little hope of redress against those who assaulted them. In Europe and Oceania, migrant women face economic and social marginalization, and are often unable to access support services because of their immigration status, leaving them trapped in abusive relationships. In 2010, women belonging to Muslim minorities in the global North choosing to wear the face veil also faced increasing pressure, with bans under discussion in many countries. In the Middle East and Africa, minority and indigenous women continue to be subjected to religious and customary legal systems that deny them their rights, while Iraqi refugee women (many of whom belong to religious minorities) elsewhere in the Middle East are increasingly vulnerable to trafficking and sexual exploitation. In Asia, sexual violence against women has again been used as a weapon against minority women, while land seizures are resulting in further economic marginalization of indigenous groups. Migration law is setting the new parameters for international protection. Irregular migration is producing new forms of statelessness. International conventions on statelessness, refugees and migrant workers and international human rights instruments do not provide effective protection for these contemporary groups of stateless persons. The case study of Burmese irregular migrant workers in Thailand demonstrate that women and children are among the most unprotected because of the gendered construction of statelessness. The book concludes firstly that the 1999 CEDAW Protocol is an avenue through which stateless women may pursue redress. Secondly, it argues that it is imperative to set international law limits on state powers over immigration matters.

Group vulnerability has become a common concept within legal and political scholarship but remains largely undertheorized as a phenomenon itself. At the same time, in academia and within legal circles, vulnerability is primarily understood as a phenomenon affecting individuals, and the attempts to identify vulnerable groups are discredited as essentialist and stereotypical. In contrast, this book demonstrates that a conception of group vulnerability is not only theoretically possible, but also politically and legally necessary. Two conceptions of group vulnerability are discussed: one focuses on systemic violence or oppression directed toward several individuals, while another requires a common positioning of individuals within a given context that conditions their agency, ability to cope with risks and uncertainties, and manage their consequences. By comparing these two definitions of group vulnerability and their implications, Macioce seeks a more precise delineation of the theoretical boundaries of the concept of group vulnerability.
