Book excerpt: Excerpt from The Recognition of Panama: Address Delivered at Massachusetts Reform Club, December 5, 1903 In order to discuss intelligently the action of the administration toward the Republic of Colombia, it is necessary first to know the facts, and I will endeavor to state these briefly. The treaty of 1846 between the United States and New Granada, in the words of Secretary Hay, "is not dependent for its efficacy on the personnel of the signers or the name of the territory it affects," but "is a covenant, as the lawyers say, that runs with the land." That is, it binds both the United States and the Republic of Colombia, which has succeeded to the rights and obligations of New Granada. This treaty contained the following reciprocal agreements: "The government of New Granada guarantees to the government of the United States that the right of way or transit across the Isthmus of Panama upon any modes of communication that now exist, or that may hereafter be constructed, shall be open and free to the government and citizens of the United States," and "as an especial compensation for the said advantages and for the favors they have acquired by the fourth, fifth, and sixth articles of this treaty the United States guarantee positively and efficaciously to New Granada by the present stipulation the perfect neutrality of the before-mentioned isthmus with the view that the transit from one sea to the other may not be interrupted or embarrassed in any future time while this treaty exists, and in consequence the United States also guarantee in the same manner the rights of sovereignty and property which New Granada has and possesses over the said territory."
