Book excerpt: Excerpt from The Question of Aborigines: In the Law and Practice of Nations; Including a Collection of Authorities and Documents, Written at the Request of the Department of State The instructions of the Department in regard to the making of this study of authorities and documents state that the plan does not. In general, contemplate research prior to the period of the Congress of Vienna, but that this limitation is not imperative. The peace of 1763 between Great Britain and France, involving as it did the trans fer of territory inhabited by aboriginal tribes, would seem to have been the occasion of an investigation into the law of nations on this subject which resulted in the formulation of the basic principles sub sequently applied by the European nations and 'the United States. Therefore the peace of 1763, rather than the Congress of Vienna, is in this study taken as beginning of the modern law on the subject.
