Book excerpt: """A just knowledge of the maxims, we ought to follow in the course of life, is the principal object of wisdom; and virtue consists in putting them constantly in practice, without being ever diverted from so noble a pursuit." -Jean-Jacques Burlamaqui, The Principles of Natural Law (1748) The Principles of Natural Law and Politic Law (1807) by Jean-Jacques Burlamaqui was originally published in two volumes, Principes du droit naturel (1747) and Principes du droit politique (1751) and was translated from French to English by Thomas Nugent (1748, 1752). This fifth edition transcends time with its readable format and definitions of all aspects of the human experience. Burlamaqui explains how God, law, and man are related and outlines many of the ideals upon which the United States was founded, in particular, the unique perspective that people have a right to pursue happiness. Book excerpt: Excerpt from The Principles of Natural and Politic Law, Vol. 1 of 2: In Two Volumes To intrude in this manner upon your time, so usefully employed in the duties of your profession, would expose me in some measure to blame, were it upon a less important occasion, than that of recommending the following work to your generous protection. The dignity of the subject, which, handled by other pens, has been thought worthy of being inscribed to the most illustrious personages of the last and present age, will plead, I hope, some excuse for an address, which is designed not so much to interrupt your occupations, as to avail itself of the sanction of your name in introducing this work to the public. And indeed a nobler subject I could not select for the favor of your acceptance, than that, which so nearly relates to the moral duties of life, and the foundation of human contentment and happiness; a subject moreover illustrated by one of the ablest masters of the present age, whose extraordinary ability and skill in curing the disorders of the mind, may be compared very aptly to yours in removing those of the body. One of the principal encouragements I had to this address is the near relation between the following work and those elevated sentiments, with which you have been always inspired. Download or read book The Principles of Natural and Politic Law written by Jean Jacques Burlamaqui and published by . This book was released on 1763 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Burlamaqui outlined a constitutional system based on principles similar to those of the American founding fathers. "Burlamaqui formulated the principles of popular sovereignty, of delegated power, of a constitution as a fundamental law, of a personal and functional separation of powers into three independent departments...and finally, he provided for an institutional guardian of the fundamental law" (Harvey.) Burlamaqui's other great achievement was to put Pufendorf's theories into systematic form. Blackstone was among the many jurists influenced by this work. Marvin stated a general opinion when he observed that "his works are deservedly held in high esteem." -- Legal Bibliography, 162. Book The Principles of Natural and Politic Law

Download or read book The Principles of Natural and Politic Law written by Jean Jacques Burlamaqui and published by Natural Law and Enlightenment. This book was released on 2006 with total page 579 pages. Available in PDF, EPUB and Kindle. Book excerpt: The year 1694 saw the death of Samuel Pufendorf, who, with Hugo Grotius, was the foremost representative of the modern tradition of natural law theory, and the birth of Jean-Jacques Burlamaqui, who helped transform the tradition and convey it to new generations. As professor of natural law in Geneva, Burlamaqui used Pufendorf’s works on natural law but taught and wrote on the subject in the vernacular, not in the traditional university Latin. By making natural jurisprudence more accessible, Burlamaqui helped make it part of civic education. Burlamaqui intended his writings to defend a middle road between the two main rival traditions in early modern natural law theory, that deriving from Leibniz and Wolff and that from Pufendorf and Barbeyrac. In fact, he seems closer to the former. The basis of this version of The Principles of Natural and Politic Law is Thomas Nugent’s 1763 English translation, which became a standard textbook at Cambridge and at many premier American colleges, including Princeton, Harvard, and the University of Pennsylvania. The first scholarly work on Burlamaqui was written by an American, M. Ray Forrest Harvey, who in 1937 argued that Burlamaqui was well known among America’s Founding Fathers and that his writings exerted considerable influence upon the American constitutional system. In his introduction, Nugent said of Burlamaqui: "His singular beauty consists in the alliance he so carefully points out between ethics and jurisprudence, religion and politics, after the example of Plato and Tully, and the other illustrious masters of antiquity.” Jean-Jacques Burlamaqui (1694-1748) was a Swiss jurist. His chief works are Principes du droit naturel (Principles of Natural Law) (1747) and Principes du droit politique (Principles of Political Law) (1751). Petter Korkman is a Fellow at the Helsinki Collegium for Advanced Studies and is a Postdoctoral Researcher in Philosophy at the Academy of Finland. Knud Haakonssen is Professor of Intellectual History and Director of the Centre for Intellectual History at the University of Sussex, England.
