Book excerpt: Originally published: Cambridge: Cambridge University Press, 1908. xxviii, 547 pp. Although Maitland never intended to publish these lectures, they have long been regarded as one of the best introductions to the English Constitution. Delivered in the winter of 1887 and spring of 1888, and edited and published in 1908 by one of Maitland's students, Herbert A.L. Fisher, they cover the period from 1066 to the end of the nineteenth century. Rather than a narrative historical format, they focus on describing the work of the constitution during five distinct moments in English history: 1307, 1509, 1625, 1702 and 1887. They provide an entry to some of the major concepts he later expounded in his seminal work written with Sir Frederick Pollock, The History of English Law. Widely considered the father of modern legal history, FREDERIC WILLIAM MAITLAND 1850-1906] was an English jurist and historian best known for The History of English Law Before the Time of Edward I (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in1876 and practiced until 1884, when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works had a profound influence on legal scholarship and remain important today.

Book excerpt: Excerpt from A History of the British Constitution The great nobles of the Norman and early Angevin times would, if they could, have reduced the king to the position of a feudal overlord, cut off from direct authority over the mass of the people by intervening grades of feudal order. That they failed to do so was due to the fact that the anglo-saxon period had taught the English freeman to regard the king as a national officer, and that William the Conqueror and Henry I. Had the sagacity to recognize and encourage this feeling. As a result, an informal alliance between the crown and the people grew up. When the chartered towns began to develop a local political life based not on land but on trade and industry, it was to the crown that they turned for support. But it was not through any wish of their own that the Com mons began to play a part in national affairs, but because the crown called them in to redress the balance of feudal oligarchy. Throughout the Middle Ages political representation was regarded as a burden rather than a privilege. It was Edward i.'s supreme title to greatness that he recognized that the feudal expression of the idea of govern ment by consent must give place to the national. In the writs Of summons to the Model Parliament of 1295, he re asserted the fundamental principle of the Old Teutonic assembly that common danger should be met by means devised in common. Book excerpt: Excerpt from Constitutional History of England I have endeavored in writing this book to keep constantly in view the needs of the general reader and of the college student. I have to join in the recurring lament of those who attempt to write a small book on a large subject that they are obliged to omit so many details and that the task of selection is so difficult. In this book I have especially regretted the fact when I have thought it necessary to omit details which one teacher of English history or another has urged me to include. It seemed to me certain, however, that the chief thing to keep always in mind was to make the continuous growth of the constitution from generation to generation as clear as possible. Details in this line, or which help to make it clear, must be included. Details which are not in the direct line may be omitted, if space demands, and must be if their inclusion would tend to confuse the larger view. I am sure that some teachers will not agree with my selection, but they will not find it a disadvantage that considerable opportunity is given for the expansion of the narrative by the teacher. I believe the book will be found to include those matters which all teachers agree are essential. It will be especially useful, I think, to expand the Introduction into a more full description of the present English government, in order that the student may know from the beginning "how the play is going to end," and what the important differences are between the American and English constitutions. It is desirable also that the student should be well grounded in English political history, which is here taken for granted, or that he should follow the account closely in some manual of the political history.
