Book excerpt: California defines spousal abuse as the willful infliction of "corporal injury" on a spouse, former spouse, cohabitant, or parent of the defendant's child. For a conviction of this type of domestic violence the prosecution must show that the defendant willfully inflicted "corporal injury on a victim" and that the injury resulted in the victim suffering a "traumatic condition." Essentially, this means that any intentional physical violence against one's spouse or former spouse that causes that spouse to suffer external or internal wounds such as scratches, cuts, bruises, or suffocation, may constitute spousal abuse. Depending on the seriousness of the facts of the case, the prosecutor may charge the defendant with either a misdemeanor or a felony. One who is facing these kinds of charges should immediately retain the assistance of a criminal defense attorney. Regardless of whether the defendant is innocent or guilty, their livelihood is threatened by this charge. Anything that defendant does or says without first consulting an attorney could negatively impact his defense at trial.

Book excerpt: "Random samples of TANF recipients eligible for welfare-to-work activities (N=632) were surveyed in two California counties for three consecutive years, starting in 1999. Overall, 54% of women interviewed at all three rounds met the criteria for an "estimated need for domestic violence services" category at some point during the three years, but only 8% met the criteria in all three years. Physical abuse, work-related abuse, serious abuse, and estimated need for service were all negatively associated with working at least 32 hours a week at the time of the interviews. Estimated need for services was associated with working fewer weeks in a year, lower wage income, and with loss of jobs during the year. Approximately half of the women with estimated service needs had sought help from police, courts, a domestic violence agency, a counselor or a physician"--p. [1].
