Excerpt: ... ings of inferior tribunals are scrutinized only applies to the question of jurisdiction, and when the existence of jurisdiction is proved or conceded, the maxim omnia rile acta applies to them as well as to courts of general jurisdiction.1 The mandate or writ of a superior court or superior magistrate, as one of the judges of those courts acting according to the course of the common law, is uot to be regarded or examined with the same strictness as the warrant of an ordinary magistrate, or other person acting by special statutory authority and out of the course of the common law. In the case of officers of special or limited jurisdiction, all instruments by which they act, such as warrants to arrest, commitments, orders, convictions, or inquisitions, ought, according to the course of the decisions, to show their authority on the face of them by direct averment or reasonable intendment; but not so with the process of superior courts acting by the authority of the common law. It will be presumed that writs issued by superior courts are duly issued and in a case in which they have jurisdiction, unless the contrary appears on the fece of them. A failure to set forth the cause of arrest would be fatal in a warrant issued by an inferior court, but this omission will not invalidate the warrant issued by a superior court. In such a case, Lord Coke says, if it express no cause at all, it will be legal.2 279. Oath, Jurat, and Seal -- At the earlier common law a justice of the peace could issue his warrant and commit without oath, though Lord Holt said " he is not wise if he doth so, for then he must make out the cause of commitment at his ]>eril; but if oath be made, lie is safe."3 The recent doctrine of the king's bench, however, is...

Book Federal Habeas Corpus

    Book Details:
  • Author : Charles Doyle
  • Publisher : Nova Publishers
  • Release : 2007
  • ISBN : 9781600213021
  • Pages : 82 pages

Download or read book Federal Habeas Corpus written by Charles Doyle and published by Nova Publishers. This book was released on 2007 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: Federal habeas corpus is a procedure under which a federal court may review the legality of an individual's incarceration. It is most often the stage of the criminal appellate process that follows direct appeal and any available state collateral review. The law in the area is an intricate weave of statute and case law. Current federal law operates under the premise that with rare exceptions prisoners challenging the legality of the procedures by which they were tried or sentenced get "one bite of the apple." Relief for state prisoners is only available if the state courts have ignored or rejected their valid claims, and there are strict time limits within which they may petition the federal courts for relief. Moreover, a prisoner relying upon a novel interpretation of law must succeed on direct appeal; federal habeas review may not be used to establish or claim the benefits of a "new rule." Expedited federal habeas procedures are available in the case of state death row inmates if the state has provided an approved level of appointed counsel. The Supreme Court has held that Congress enjoys considerable authority to limit, but not to extinguish, access to the writ. This report is available in an abridged version as CRS Report RS22432, "Federal Habeas Corpus: An Abridged Sketch," by Charles Doyle.
