Book excerpt: Do small but wealthy interest groups influence referendums, ballot initiatives, and other forms of direct legislation at the expense of the broader public interest? Many observers argue that they do, often lamenting that direct legislation has, paradoxically, been captured by the very same wealthy interests whose power it was designed to curb. Elisabeth Gerber, however, challenges that argument. In this first systematic study of how money and interest group power actually affect direct legislation, she reveals that big spending does not necessarily mean big influence. Gerber bases her findings on extensive surveys of the activities and motivations of interest groups and on close examination of campaign finance records from 168 direct legislation campaigns in eight states. Her research confirms what such wealthy interests as the insurance industry, trial lawyer associations, and tobacco companies have learned by defeats at the ballot box: if citizens do not like a proposed new law, even an expensive, high-profile campaign will not make them change their mind. She demonstrates, however, that these economic interest groups have considerable success in using direct legislation to block initiatives that others are proposing and to exert pressure on politicians. By contrast, citizen interest groups with broad-based support and significant organizational resources have proven to be extremely effective in using direct legislation to pass new laws. Clearly written and argued, this is a major theoretical and empirical contribution to our understanding of the role of citizens and organized interests in the American legislative process.

This has led to a widespread view that populism as such is inconsistent with constitutionalism. This book proposes that some forms of populism are inconsistent with constitutionalism, while others aren't. Context and detail matter. Power to the People offers a thin definition of constitutionalism that people from the progressive left to the conservative right should be able to agree on even if they would supplement the thin definition within other more partisan ideas. This is followed by a similarly basic definition of populism. Comparing the two, this book argues that one facet of populism -its suspicion of institutions that are strongly entrenched against change by political majorities-is sometimes inconsistent with constitutionalism's thinly understood definition. The book provides a series of case studies, some organized by nation, others by topic, to identify, more precisely, when and how populist programs are inconsistent with constitutionalism-and, importantly, when and how they are not. Concluding with a discussion of the possibilities for a deeper, populist democracy, the book examines recent challenges to the idea that democracy is a good form of government by exploring possibilities for new, albeit revisable, institutions that can determine and implement a majority's views without always threatening constitutionalism.

In the wake of its conservative capture during the Nixon and Reagan eras, and given its increasing ubiquity as a mainstream buzzword of politicians and pundits, democratic theorists and activists have been eager to abandon populism to right-wing demagogues and mega-media spin-doctors. Decades of liberal scholarship have reinforced this shift, turning the term "populism" into a pejorative in academic and public discourse. At best, they conclude that populism encourages an "empty" wish to express a unified popular will beyond the mediating institutions of government; at worst, it has been described as an antidemocratic temperament prone to fomenting backlash against elites and marginalized groups. Populism's Power argues that such routine dismissals of populism reinforce liberalism as the end of democracy. Yet, as long as democracy remains true to its meaning, that is, "rule by the people," democratic theorists and activists must be able to give an account of the people as collective actors. Without such an account of the people's power, democracy's future seems fixed by the institutions of today's neoliberal, managerial states, and not by the always changing demographics of those who live within and across their borders. Laura Grattan looks at how populism cultivates the aspirations of ordinary people to exercise power over their everyday lives and their collective fate. In evaluating competing theories of populism she looks at a range of populist moments, from cultural phenomena such as the Chevrolet ad campaign for "Our Country, Our Truck," to the music of Leonard Cohen, and historical and contemporary populist movements, including nineteenth-century Populism, the Tea Party, broad-based community organizing, and Occupy Wall Street. While she ultimately expresses ambivalence about both populism and democracy, she reopens the idea that grassroots movements--like the insurgent farmers and laborers, New Deal agitators, and Civil Rights and New Left actors of US history--can play a key role in democratizing power and politics in America.
