For Judaism, the Mishnah—along with Scripture—sets forth the systematic statement for understanding the social construction and world view of Judaism around 200 C.E. The Mishnah functioned as the basic law in the holy land and was adopted also by Jews in the Diaspora, from Babylonia to the western satrapies of the Iranian empire of the Sasanians. Professor Jacob Neusner takes seriously the three principal tasks of theoretical thought enjoined by Aristotle and asks us to look at the Mishnah not as an inert collection of traditions passed on, but as a deliberate, programmatic statement of Judaism’s way of life and world view. He points to the systematic nature of the Mishnah, with its six divisions, and shows how collectively those divisions cover the everyday life of the people. The Mishnah contains independent judgements about the nature of the system and does not merely rehearse what tradition says about a given topic. This interpretive aspect of the Mishnah has been ignored to the interpreter’s peril, because it is precisely by paying attention to how the Mishnah uses traditions for its own purposes that the interpreter can appreciate the building blocks of Judaism: its politics, economics, and philosophy. It is written in several languages and follows rules that in certain circumstances trigger the use of one language over others. Its components are diverse. To translating it requires elaborate complementary language. It cannot be translated verbatim into any language. So a translation is a commentary in the most decisive way. The Talmud, accordingly, cannot be merely read but only studied. It contains diverse programs of writing, some descriptive and some analytical. A large segment of the writing follows a clear pattern, but the document encompasses vast components of miscellaneous collections of bits and pieces, odds and ends. It is a mishmash and a mess. Yet it defines the program of study of the community of Judaism and governs the articulation of the norms and laws of Judaism, its theology and its hermeneutics, Above all else, the Talmud of Babylonia is comprised of contention and produces conflict and disagreement, with little effort at a resolution No wonder the Talmud confuses its audience. But that does not explain the power of the Talmud to define Judaism and shape its intellect. This book guides those puzzled by the Talmud and shows the system and order that animate the text.

These category-formations everywhere pursue a cogent analytical program, addressing diverse subjects, treated systematically, a single set of questions of definition and analysis. Is Scripture the origin of the Halakhic system, which defines the norms of Judaism? At stake is not the starting point of discrete bits of legal data. At issue is the origin of the comprehensive structure comprised by the Halakhic category-formations, by these topics and no others. Scripture forms the natural starting point for any inquiry into the origins of Judaism. So it is quite natural to treat Scripture as the base-line and the Halakhic category-formations as the variable when seeking the origin of the system. But what happens when, as in this project, we treat the system as the base-line and Scripture as the variable? Then we see that the Halakhic system viewed as a coherent statement does not originate in Scripture. Important parts of that statement do, important parts do not. But the system viewed whole does not.

In this fourth volume of his examination of major formative texts of Judaism, Jacob Neusner explains how and why the Bavli came to define the Jewish faith from its time to ours. Through an analysis of the text, its sources and editorial organization, he traces the history of the composition of the Babylonian Talmud, clarifies its relation to the earlier corpus of canonical literature, and clearly establishes its philosophical, religious, and cultural context. Because there is little objective, external evidence from which to interpret the Bavli's development, Neusner uses the signs of redactional layering within the literature to discover the motivations and techniques by which the Talmud was formed. His use of the critical, secular methods of modern literary and historical study is unique in Talmudic exegesis and provides an entirely new perspective for understanding the Bavli in relation to the Mishnah and Yershalmi, the Jerusalem Talmud. Much of Neusner's research compares the use of the various literary forms of the Mishnah by the editors of the two Talmuds. Offering detailed examples and statistical lists to buttress his analysis, he argues that only in the Bavli have the editors achieved a genuine redactional synthesis between the Mishnah and Hebrew Scriptures, the two major sources of the Jewish tradition. In conclusion, Neusner spells out the religious significance of Bavli's achievement and shows how this unique combination allows for the tradition's continual renewal.

Book excerpt: With the conversion of Constantine in 312, Christianity began a period of political and cultural dominance that it would enjoy until the twentieth century. Jacob Neusner contradicts the prevailing view that following Christianity's ascendancy, Judaism continued to evolve in isolation. He argues that because of the political need to defend its claims to religious authenticity, Judaism was forced to review itself in the context of a triumphant Christianity. The definition of issues long discussed in Judaism—the meaning of history, the coming of the Messiah, and the political identity of Israel—became of immediate and urgent concern to both parties. What emerged was a polemical dialogue between Christian and Jewish teachers that was unprecedented. In a close analysis of texts by the Christian theologians Eusebius, Aphrahat, and Chrysostom on one hand, and of the central Jewish works the Talmud of the Land of Israel, the Genesis Rabbah, and the Leviticus Rabbah on the other, Neusner finds that both religious groups turned to the same corpus of Hebrew scripture to examine the same fundamental issues. Eusebius and Genesis Rabbah both address the issue of history, Chrysostom and the Talmud the issue of the Messiah, and Aphrahat and Leviticus Rabbah the issue of Israel. As Neusner demonstrates, the conclusions drawn shaped the dialogue between the two religions for the rest of their shared history in the West.
