Book The Patient Abuse and Neglect of Our Vulnerable Adults

Download or read book The Patient Abuse and Neglect of Our Vulnerable Adults written by Joseph S. Bostwick and published by . This book was released on 2008-01 with total page 160 pages. Available in PDF, EPUB and Kindle. Book excerpt: Patient abuse and neglect is a daily occurrence in our nation's medical and psychiatric hospitals, nursing homes, group homes, and other care facilities. But it is not just in institutional settings where at-risk adults are vulnerable. Crimes of abuse also occur in private homes, beyond the sight of regulators, medical professionals, and even family members. Using real-world examples from Joseph Bostwick's extensive career leading investigations into cases of patient abuse, The Patient Abuse and Neglect of Our Vulnerable Adults provides law enforcement officers, investigators, legal staff, government regulatory agencies, and care providers with the critical information they need to effectively conduct criminal and administrative investigations into allegations of patient mistreatment and neglect. It also provides families and friends with information and resources for identifying and preventing the abuse and neglect of loved ones. Today, we tend to our vulnerable adults who served our country during World War II, the generation that literally saved the world. Tomorrow, another wave of vulnerable adults awaits our care and protection. The battle against patient abuse and neglect is never-ending, and well-intentioned support and informed diligence is crucial, today and always.

Book Elder Abuse and Its Prevention

Download or read book Elder Abuse and Its Prevention written by National Research Council and published by National Academies Press. This book was released on 2014-03-18 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: Elder Abuse and Its Prevention is the summary of a workshop convened in April 2013 by the Institute of Medicine's Forum on Global Violence Prevention. Using an ecological framework, this workshop explored the burden of elder abuse around the world, focusing on its impacts on individuals, families, communities, and societies. Additionally, the workshop addressed occurrences and co-occurrences of different types of abuse, including physical, sexual, emotional, and financial, as well as neglect. The ultimate objective was to illuminate promising global and multisectoral evidence-based approaches to the prevention of elder maltreatment. While the workshop covered scope and prevalence and unique characteristics of abuse, the intention was to move beyond what is known about elder abuse to foster discussions about how to improve prevention, intervention, and mitigation of the victims' needs, particularly through collaborative efforts. The workshop discussions included innovative intervention models and opportunities for prevention across sectors and settings. Violence and related forms of abuse against elders is a global public health and human rights problem with far-reaching consequences, resulting in increased death, disability, and exploitation with collateral effects on well-being. Data suggest that at least 10 percent of elders in the United States are victims of elder maltreatment every year. In low- and middle-income countries, where the burden of violence is the greatest, the figure is likely even higher. In addition, elders experiencing risk factors such as diminishing cognitive function, caregiver dependence, and social isolation are more vulnerable to maltreatment and underreporting. As the world population of adults aged 65 and older continues to grow, the implications of elder maltreatment for health care, social welfare, justice, and financial systems are great. However, despite the magnitude of global elder maltreatment, it has been an underappreciated public health problem. Elder Abuse and Its Prevention discusses the prevalence and characteristics of elder abuse around the world, risk factors for abuse and potential adverse health outcomes, and contextually specific factors, such as culture and the role of the community.

Download or read book Elder Mistreatment written by National Research Council and published by National Academies Press. This book was released on 2003-02-06 with total page 569 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the late 1970s when Congressman Claude Pepper held widely publicized hearings on the mistreatment of the elderly, policy makers and practitioners have sought ways to protect older Americans from physical, psychological, and financial abuse. Yet, during the last 20 years fewer than 50 articles have addressed the shameful problem that abusersâ€"and sometimes the abused themselvesâ€"want to conceal. Elder Mistreatment in an Aging America takes a giant step toward broadening our understanding of the mistreatment of the elderly and recommends specific research and funding strategies that can be used to deepen it. The book includes a discussion of the conceptual, methodological, and logistical issues needed to create a solid research base as well as the ethical concerns that must be considered when working with older subjects. It also looks at problems in determination of a report's reliability and the role of physicians, EMTs, and others who are among the first to recognize situations of mistreatment. Elder Mistreatment in an Aging America will be of interest to anyone concerned about the elderly and ways to intervene when abuse is suspected, including family members, caregivers, and advocates for the elderly. It will also be of interest to researchers, research sponsors, and policy makers who need to know how to advance our knowledge of this problem.

It is about creating a place where everyone is safe. It is that place where they can be everything they are intended to be. My Plan to Protect® Pocket Guide for Vulnerable Adults highlights the best practices of our well respected protection manual Plan to Protect® which is now used in over 7,500 organizations, churches, NGOs, schools, care facilities and camps across Canada. It is an excellent tool to place in the hands of volunteers, staff, family members and leaders. "Pocket Guide of Best Practices for Vulnerable Adults is a most welcomed addition to the growing resources for responsible care of the aging, and is especially to be applauded amidst the current demographic acceleration of aging. Already almost 10% of the elderly population experience some type of abuse and the numbers are growing. I heartily recommend this short Guide as a means to raise our awareness of the issues while encouraging our hearts to respond. It provides informed and compassionate guidance and can serve as the basis for further training or a handy reference manual. May it encouragement each of us to do all we can to fill the gap between the vulnerable and the care-filled honour called for.” Dr. Tom McCormick [PhD, University of Texas, Arlington; PhD, Institute for Christian Studies; MA, Westminster Seminary, Philadelphia]

Book Vulnerable Adults and the Law

  • Author : Jonathan Herring

Download or read book Vulnerable Adults and the Law written by Jonathan Herring and published by Oxford University Press. This book was released on 2016-01-21 with total page 404 pages. Available in PDF, EPUB and Kindle. Book excerpt: We are used to thinking that most people have the capacity to make their own decisions; that they should be free to decide how to live their lives; and that it is a good thing to be self-sufficient. However, in an examination of the legal position of vulnerable adults, understood as those who have capacity under the Mental Capacity Act 2005 but are deemed impaired through vulnerability in their exercise of decision making powers, Jonathan Herring challenges that assumption. Drawing on feminist and disability perspectives he argues that we are all in fact, 'vulnerable' and we need to replace the competent, able-bodied, independent person as the norm which the law is based on and instead fashion which recognises our interdependence and mutuality. At the heart of the law is a distinction between those who have capacity and those who do not. Those who have capacity are given the full rights of the law; they are entitled to enter contracts, dispose of their property, are able to marry. Those who are deemed to lack capacity are unable to make these decisions. Their decisions are made on their behalf based on an assessment of what is in their best interests. This approach is underpinned by the principle of autonomy, and is problematic for those who are deemed 'vulnerable'. The Court of Protection and the Court of Appeal have developed a jurisdiction to deal with cases involving vulnerable adults which has been used in a wide range of cases from those involving people with early stage dementia to cases of forced marriage. This development of law has proved controversial and the courts have struggled to draw its limits and explain the justification for it. Jonathan Herring welcomes the courts willingness to protect vulnerable adults through the inherent jurisdiction, but argues that we need to go much further. It is not just particular groups such as 'the elderly' or 'the disabled' who are vulnerable, but rather vulnerability is part of the human condition. This means that caring relationships are of central significance to our society and should be at the heart of the legal system.
