Book excerpt: During the first six of the ten months covered by this volume, Madison completed his initial period of service as a delegate from Virginia in the Congress of the Confederation. His correspondence with Thomas Jefferson and Edmund Randolph, as well as his other papers, reveal the mounting difficulties besetting him and his fellow nationalists who sought to preserve a union among the thirteen states. The major problems, which included demobilizing the discontented army, obtaining public revenue, funding the Confederation debt, pressing the British to evacuate their military posts, enforcing the preliminary articles of peace, creating a public domain in the West, locating a provisional or permanent capital of the Confederation, and negotiating commercial treaties with European powers, fostered sectionalism, factionalism, and an emphasis upon state sovereignty. As a prominent member of Congress, Madison sought legislative and constitutional remedies for this menacing divisiveness. To him the maintenence of the new nation embodied "the greatest trust ever confided to a political society," for it was "the last and fairest experiment in favor of the rights of human nature." Early in December, after an absence of over three years, Madison returned to Montpelier, his father's estate. There during the winter of 1783-1784, he studied law, renewed old friendships, and canvassed the residents of Orange County for support of his candidacy for election to the House of Delegates of the Virginia General Assembly. maintenance

It could not have been less fair, to consider the six as declaratory of the law, and the two as exceptions to it. But in either case, the inference presupposes, instead of proving, the point in question. As far as the point was to be considered as not otherwise proved, and as requiring the evidence of treaties to remove the uncertainty, the inference ought to have been reversed. The six witnesses ought to have out-weighed the two, and it was incumbent on the reporters, instead of simply referring to the treaties as a confirmation of their opinion, to have considered them as presenting an ostensible objection, which was to be answered. over, the practice of nations, not being uniform, is an unsatisfactory guide; and consequently, that the evidence of treaties were necessary in order to ascertain the law; still, it will be found that the result of an appeal to that evidence is conclusive against the British pretension. It may be confidently affirmed, that on no point ever drawn into question, the evidence of Treaties was more uniform, more extensive, or more satisfactory. Nay more; it may be affirmed that the treaties applicable to this case may fairly be considered in their relation to the law of nations last noticed; that is, as constituting a law of themselves. If, in any case, Treaties can be sufficiently general, sufficiently uniform, and of sufficient duration, to attest that general and settled concurrence of nations in a principle or rule of conduct among themselves, which amounts to the establishment of a general law; such an effect cannot reasonably be refused to the number and character of the treaties which are applicable to the present...

Book excerpt: The 605 documents presented in Volume 7 of The Papers of James Monroe date from April 1814, the midpoint of Monroe's term as secretary of state under President James Madison, to March 1817, just prior to his inauguration as president. Volume 7 opens in the midst of the War of 1812, documenting Monroe's role as military adviser to President Madison during an ill-fated defense of Washington in August 1814, his appointment as secretary of war in September 1814, and his return to the State Department in March 1815, when he began the work of normalizing relations with the European nations after the end of the Napoleonic wars. Relations with Great Britain remained uneasy, but Monroe reduced friction by negotiating the 1817 Rush-Bagot Treaty, which led to disarmament of the Great Lakes. Numerous documents detail the ill will between the United States and Spain caused by the war, disagreement over possession of Florida, and the revolutions in Spain's American colonies. The volume also addresses the presidential election of 1816. Monroe, in line with the accepted practice at the time, avoided any overt acts that would indicate he was seeking the office.
