Nearly all the nations of Europe have furnished their quota for making up the population of the United States, so that if each stock had preserved its original characteristics, the aggregate of the inhabitants of this country would have resembled the conglomerate or pudding-stone formation in geology, in which angular and rounded pebbles, with every variety of size, shape, and internal composition, are merely held together by a rocky cement, - united by juxtaposition, but by no chemical affinities. A monarchical government, which has extended its dominions by conquest, and holds the greater portion of them merely by the sword, causes only this imperfect and unnatural union among the several classes of its subjects; - the mortar which binds them may be more or less indurated, according to its degree of native strength, or to the lapse of time during which it has been exposed to the action of elemental forces; but the pebbles imbedded in it continue unchanged; their form remains as it was determined by mutual attrition, when they were free to roll over each other under the impulse of the waves and the resistance of the beach. This writer was Pothier, whom he afterwards noticed and imitated in his beautiful essay on the Law of Bailments, and of whose treatises on the different species of contracts he speaks in the following enthusiastic manner: 'I seize with pleasure an opportunity of recommending those treatises to the English lawyer, exhorting him to read them again and again; for if his great master, Littleton, has given him, as it must be presumed, a taste for luminous method, apposite examples, and a clear manly style, in which nothing is redundant, nothing deficient, he will surely be delighted with works in which all those advantages are combined, and the greatest portion of which is law at Westminster as well as at Orleans. The prince, for whom Mozart composed music, Kaunitz negotiated, and Laudon won victories, occupies a prominent station among the sovereigns of Austria. The contrast between monarchies and democratic states is in nothing more striking, than in the degrees and amount of political abilities, which they respectively call into action. Men may dispute, if they will, whether liberty be the fostering parent of the arts, and may continue to raise questions respecting the influence of forms of government on letters; but the turbulent contests, the unsparing and unqualified competition, allowed in popular states, quicken natural talents and furnish every facility and every inducement for their display. At courts the race is not necessarily to the swift; and men are naturally turned aside from the career of the public service, when no scope is furnished them for the full exercise of natural powers and the manly struggle for honors. As a rule, I am quite willing to accept Brander Matthews's literarv judgments and applaud his lucid and graceful phrasing of them but that particular statement needs to be taken with a few tons of salt. Bless your heart, Cooper hadn't any more invention than a horse; and I don't mean a high class horse, either; I mean a clothes-horse. It would be very difficult to find a really clever situation in Cooper's books and still more difficult to find one of any kind which he has failed to render absurd by his handling of it. Look at the episodes of the caves i and at the cele brated scuffle between Maqua and those others on the table-land a few days later and at Hurry Harry's queer water-transit from the castle to the ark and at Deerslayer's half hour with his first corpse and at the quarrel between Hurry Harry and Deerslayer later and at - but choose for yourself you can't go amiss. He understands what he does, and he does what he prefers to do. Moreover, as actions lead to events by invariable laws, they are the legitimate subjects of rules. But moral rules, as they are designed to act upon the will, must, in order to be of any avail, be adjusted with reference to those motives or springs of action which immediately in fluence the will. The springs of action our author enumer ates as follows: The Appetites or Bodily Desires; the Afl'ections the Mental Desnres the Moral Sentiments and the Reflex Sentiments, under which head he classes the desire of love or esteem from others, and the desire of our own approval, together with all those Springs of Action which are designated by some compound of the world Self as Self-fldmt'ration, self-love. This last class seems to us redundant. We can trace no difference in kind between the desire of superiority, enumerated among the mental desires, and that of popularity or fame, which is put among the reflex sentiments. Book excerpt: Excerpt from The North American Review To find the enemy and to overwhelm him requires a far less comprehensive talent than that needed to mould the new elements, hostile as well as friendly, into such a government as shall embody the political theories of the victorious party. It is for this reason that many a time a political party under the lead of a skilful general has succeeded in completely vanquishing its enemies in the field, only to fall a speedy prey to surprising and overwhelming difficulties in the cabinet. There is nothing plainer than that revolutions, begun in the interests of the common people, have often, even when apparently successful, ended in a more complete centralization and oppression. Perhaps the most remarkable example of this abandonment of the fruits of victory, in modern history, is afforded by France at the close of the great Revolution. It has long been a fond notion with a certain class of writers, especially of French writers, that the government built up by Napoleon I. was but the substantial embodiment and establishment of those principles which impelled the nation into the civil war. Of late, however, the scales have fallen from a great many eyes, and even French historians are coming to estimate in their true character the labors and the permanent influence of the first French Emperor. The work of Lanfrey alone has been enough to dispel a multitude of illusions. We imagine it would be difficult for any one to follow his volumes honestly through without being profoundly impressed with the fact of the transformation to which we have alluded. At the time when the Revolution was at its fiercest heat, for example, the all-absorbing theory of the revolutionists was that France should not be controlled by any one man, but by the masses of the people at large; in the reign of Napoleon, however, the people were as destitute of power and influence as they had been in the days of Louis XIV. The revolutionists stoutly maintained that the executive branch of the government, no less than the legislative, should be under the control of the people but Napoleon raised himself to power without consulting the people, and then crowned his work of usurpation by re-establishing the principle of hereditary succession. Dignity is always an argument in itself, it lends a beautiful force, like that of delicate machinery, to those perfected arguments which it weaves. The man who keeps his temper; who avoids invective as a distinguished American gentleman for forty years avoided audible sneezing; who has no more taste for superficiality and sophistry than a ship-wrecked sailor for a polka; who curbs passion into persuasions, and the license of rhetoric into the liberty of logic such a man carries the presumption of favor for his case in so far as he is such a man; and he ought to. The treasure of the Christian faith is not of a kind to be borne away from us by intellectual burglary. In the next place I am reminded of the comment made on the Concord School of Philosophy by one of the keen newspaper men who have made American wit a modern discovery. The Concord students spent their time, he said, in trying to scrutineer the inscrutable and poss the impossible. The controversy in which Colonel Ingersoll has been the defendant is, I venture to say, not upon his part alone, an attempt to poss the impossible. Tactically considered, the discussion has to a marked extent followed that simple military expedient known as "firing wild." It strikes me that the chief reason for this is one for which no individual party to the encounter can be held responsible; least of all, the distinguished statesman whose scholarship, dignity, and repose have given value to the conflict if they have not won the day. Is not the main trouble with the discussion the absence of definition? Really, when we come to look at it, there is no such thing postulated between the opponents. The simplest conditions of controversy are disregarded from the start. There are no common terms. It is easy to ask, How can there be any? What can there be? Between a mind which finds it natural to call Heaven a poorhouse and Jehovah an eternal turnkey, and the mind of a devout believer in the divine mission of Jesus Christ, where is the common term? True, it may be a matter of the subtlest difficulty to find one; it may even seem to be past finding out; but for controversial purposes it is no less necessary for that.
