God and Caesar, religion and law, to an unprecedented crescendo in this country. The subject is hardly a new one. Probably in prehistoric times, as among primitive peoples today, frequent power conflicts arose between the medicine man and the chief. Certainly the problem was known to the Greeks and the Romans, though merger of the contestants frequently muted the issues. It provided the dominant theme for six hundred years of European history. The very slow development of the notion of religious toleration and the absence of any notion of separation of church and state in the English speaking world outside of America, both before and after the American Revolution, amply demonstrate the continued vitality of the problem, with dimensions until now unknown in America. Thus, for example, it may surprise some that, by law, religious qualifications for public office in England continued late into the nineteenth century. And perhaps equally disquieting is the fact that the ultimate arbiter of Anglican church doctrine is, even today, not any ecclesiastical authority but the English Parliament, most of whose members are not actively affiliated with the Anglican church. However hoary the problem, it is livelier than ever in the United States today. Federal aid to Catholic schools has become the essential issue on which many Congressional elections may turn: in the cities of the Northeast, the newly-formed Citizens Party, joined with a group called "Citizens for Educational Freedom," threatens to unseat or defeat any candidate who is not prepared to pledge himself to support federal contributions to parochial schools. And therefore, on the whole, I see no real change in my views; I see only a different emphasis, varying from time to time, now on this and now on that side of the permanent tension between the authority of the State and the voluntary play of freely formed and freely acting groups or societies. It is impos sible not to experience and confess some change of mind and alteration of view with the change of circumstance and the alter ation of contingencies. But I do not think that this means any real or substantial change of View. The tension remains: the circum stances surrounding it change: the barometer of the reflective mind just registers the consequential change in the character and balance of the tension which must always continue to exist. There have been theories and theorists who have represented the government or control of the Church by tthe State as being in substance the government of the Church by the laity, and who have justified this government upon this ground. But, though in a nation composed entirely of members of the Church, it may possibly be that the laity may preponderate over the clergy in the State, or civil society, while the clergy preponderate in the Church, yet even then the control of the Church by the State will only accidentally express the govern ment of the laity, the laity regulating a matter Of State will do so not as lay-churchmen but as citizens, and in fact to give the control Of the Church to the State in such a case is to create two rival bodies, each with despotic power in its own sphere, and with no bond Of union between them, rather than to blend with proper admixture Of powers and parts the two bodies into one harmonious constitution. This is so even when the State is composed entirely of members of the Church. Of course, directly persons who are not members Of the Church come to have civil rights and in uence in the State, all idea of the State representing the laity is gone.
