Book excerpt: Littell's provocative book offers a thoughtful analysis of the concept of state neutralization, exploring the ways in which this idea has been used to promote peace and stability throughout history. Drawing on a range of examples, Littell offers a compelling argument for why state neutralization remains a critical tool for maintaining global security. Book excerpt: Excerpt from The Neutralization of States: A Study in Diplomatic History and International Law The field was suggested to the author when investigating an allied subject. He was surprised to find that Perma nent Neutrality, although the subject of a careful study by Piccioni in French and by Richter in German, had appar ently never been written up in the English language. The subject seemed particularly Opportune because of the marked increase in interest in America in Belgium and her history, but this item played no part in determining its selection. Book Neutralization Classic Reprint

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Neutralization Neutralization is the imposition by international agreement of a condition of permanent neutrality upon lands and waterways. Neutrality, from which it is derived, is of two kinds, that which is assumed from within, and that which is imposed from without, and neutral states may be divided into those which abstain from war of their own free-will, and those which by international conventions are restrained from all hostilities whatsoever and enjoy a perpetual peace. In either case the duty of strict impartiality toward belli gerents remains the same. While simple neutrality is the condition of those states which in time of war take no part in the contest, but continue pacific intercourse with the belligerents neutralization perpetuates this condition by means of treaties effected between several powerful nations and the neutralized state. In this volume four leading scholars assess the potential uses of neutralization in the contemporary world. In interlocking essays the authors discuss the functions of neutralization, relevant historical precedents, preconditions for its establishment, methods of negotiating neutralization, maintenance of neutralization, and the prospects for neutralization in Southeast Asia today. Book Neutrality in Contemporary International Law

Download or read book Neutrality in Contemporary International Law written by James Upcher and published by Oxford Monographs in Internati. This book was released on 2020-01-19 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law of neutrality - the corpus of legal rules regulating the relationship between belligerents and States taking no part in hostilities - assumed its modern form in a world in which the waging of war was unconstrained. The neutral State enjoyed territorial inviolability to the extent that it adhered to the obligations attaching to its neutral status and thus the law of neutrality provided spatial parameters for the conduct of hostilities. Yet the basis on which the law of neutrality developed - the extra-legal character of war - no longer exists. Does the law of neutrality continue to survive in the modern era? If so, how has it been modified by the profound changes in the law on the use of force and the law of armed conflict? This book argues that neutrality endures as a key concept of the law of armed conflict. The interaction between belligerent and nonbelligerent States continues to require legal regulation, as demonstrated by a number of recent conflicts, including the Iraq War of 2003 and the Mavi Marmara incident of 2010. By detailing the rights and duties of neutral states and demonstrating how the rules of neutrality continue to apply in modern day conflicts, this restatement of law of neutrality will be a useful guide to legal academics working on the law of armed conflict, the law on the use of force, and the history of international law, as well as for government and military lawyers seeking comprehensive guidance in this difficult area of the law.

Book Knowledge for Governance

Download or read book Knowledge for Governance written by Johannes Glückler and published by Springer Nature. This book was released on 2021-01-14 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book focuses on theoretical and empirical intersections between governance, knowledge and space from an interdisciplinary perspective. The contributions elucidate how knowledge is a prerequisite as well as a driver of governance efficacy, and conversely, how governance affects the creation and use of knowledge and innovation in geographical context. Scholars from the fields of anthropology, economics, geography, public administration, political science, sociology, and organization studies provide original theoretical discussions along these interdependencies. Moreover, a variety of empirical chapters on governance issues, ranging from regional and national to global scales and covering case studies in Australia, Europe, Latina America, North America and South Africa demonstrate that geography and space are not only important contexts for governance that affect the contingent outcomes of governance blueprints. Governance also creates spaces. It affects the geographical confines as well as the quality of opportunities and constraints that actors enjoy to establish legitimate and sustainable ways of social and environmental co-existence.
