Book Community Care Practice and the Law

Download or read book Community Care Practice and the Law written by Michael Mandelstam and published by Jessica Kingsley Publishers. This book was released on 2005 with total page 562 pages. Available in PDF, EPUB and Kindle. Book excerpt: This third edition of Community Care Practice and the Law has been substantially rewritten and restructured to reflect the rapid legal and policy changes affecting the community care field. It provides comprehensive and jargon-free explanations of both community care legislation and other areas of the law directly relevant to practitioners. Topics covered include: • assessment and eligibility criteria (`fair access to care') and waiting times • placing people in care homes • non-residential, domiciliary and home care services • carers' assessments and services • home adaptations and disabled facilities grants * direct payments * continuing health care and health services generally, including community equipment services * joint working between local authorities and the NHS * single assessment process, intermediate care * decision making capacity and incapacity * information sharing * adult protection * human rights and disability discrimination * health and safety at work legislation including manual handling people subject to immigration control, including asylum seekers care standards. Numerous examples of legal cases and ombudsman investigations clearly illustrate the practical impact of legislation on community care. A separate chapter provides an at-a-glance view of the whole range of legislation underpinning the everyday work of practitioners. The author also identifies the underlying mechanisms, tensions and problems affecting community care law and practice. Primarily covering England in detail, much of the legal case law covered and the legal principles involved are of general relevance across the United Kingdom, and where material is not directly applicable to Wales, Scotland and Northern Ireland, short summaries offer general pointers for the position in these three countries. This book is an essential guide for practitioners and managers in both the statutory and voluntary sectors, policy makers in local and central government, advocates, lawyers and social work students.

This book was released on 2010-03-15 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: This short guide cuts through the confusing mass of legislation to provide a concise and jargon-free explanation of current community care practice and the law. In clear and simple language, it explains the legislation directly relevant to practitioners, including: rules about how people in need get an assessment from local authorities; the assessment of need itself; eligibility for actually getting a service (and the "fair access to care" policy); charging for services; ordinary residence; topping up of care home fees; assessing informal carers; and the rules about asylum seekers. It provides an overview and analysis of high profile issues such as direct payments, personal budgets and the policy of personalisation and National Health Service provision, including the vexed issue of NHS continuing health care. It also highlights the duties placed on local authorities and the NHS, the various tensions underlying community care, and the consequent shortcuts - both lawful and unlawful - that local authorities and the NHS feel obliged to take. Book Irregular Migration and Human Rights Theoretical European and International Perspectives

Download or read book Irregular Migration and Human Rights Theoretical European and International Perspectives written by Barbara Bogusz and published by BRILL. This book was released on 2004-09-01 with total page 485 pages. Available in PDF, EPUB and Kindle. Book excerpt: Desperate and vulnerable people, who take enormous risks to migrate to Europe in rickety boats or concealed in the containers of articulated lorries, are familiar images portrayed in the media of “irregular migrants”. Irregular migration has become a major political concern both at the European level and in the wider international context. In the European Union, politicians have identified irregular migration as a “problem” and have given priority to preventing this phenomenon in the development of the common asylum and immigration policy. This collection of essays is the outcome of an international conference on Irregular Migration and Human Rights, which gathered together prominent scholars, policy-makers and practitioners working in the migration and human rights field. The objective of the book, in contrast to the prevailing political approach which focuses almost solely on prevention, is to discuss the human rights dimensions of irregular migration from theoretical, European and international perspectives. The book is divided into five substantive parts: the complex question of who is an irregular migrant and the difficulties in assessing the size of irregular movements: official and popular perceptions of irregular migrants, a debate which is frequently considered in terms of security concerns, asylum, and human trafficking and smuggling; the myriad strands of the developing EU law and policy on irregular migration, such as the adoption of readmission agreements, and the relationship of this law and policy to external border controls in the context of EU enlargement and other non-legal means of EU decision-making; the contributions of international and non-governmental actors to charting a rights-based approach to irregular migration; and the problems these vulnerable persons face while resident in host countries, such as discrimination and denial of access to social rights and public services, which is inextricably bound up with their irregular status.
