Can the U.S. expect to maintain its current unprecedented degree of military advantage in the information-age? This thesis examines this question using a qualitative research methodology. The research analyzes the impact of information technology on the geopolitical system, the nature of conflict, and the realm of military competition. Within this context, the research examines the changing nature of military advantage. Three elements of advantage are analyzed to determine qualitative changes that result from the changing conditions of the information-age. The elements are power, legitimacy, and effects. The research also includes a comparative analysis that seeks to determine how these changing conditions affect the ability of both the U.S. military and global insurgents to gain advantage. The research concludes that U.S. military advantage will decline relative to a global insurgency. As a result, the U.S. will face significant challenges in its effort to achieve lasting success in the Global War on Terrorism (GWOT).

Almost all states involved in armed conflicts recognize that launching an attack which may cause incidental harm to civilians that exceeds the direct military advantage anticipated from the attack is prohibited. This prohibition is included in military manuals, taught in professional courses, and accepted as almost axiomatic. And yet, the exact meaning of the principle is vague. Almost every issue, from the most elementary question of how to compare civilian harm and military advantage, to the obligation to employ accurate but expensive weapons, is disputed. Controversy is especially rife regarding asymmetrical conflicts, in which many modern democracies are involved. How exactly should proportionality be implemented when the enemy is not an army, but a non-state-actor embedded within a civilian population? What does it mean to use precautions in attack, when almost every attack is directed at objects that are used for both military and civilian purposes? In Proportionality in International Humanitarian Law, Amichai Cohen and David Zlotogorski discuss the philosophical and political background of the principle of proportionality. Based on detailed analysis of the facts and law, Professor Moxley shows that the United States’ arguments that uses of nuclear weapons, including low-yield nuclear weapons, could be lawful do not withstand analysis. Moxley opens by examining established rules of international law governing the use of nuclear weapons, first analyzing this body of law based on the United States’ own statements of the matter and then extending the analysis to include requirements of international law that the United States overlooks in its assessment of the lawfulness of potential nuclear weapons uses. He then develops in detail the known facts as to nuclear weapons and their consequences and U.S. policies and plans concerning such matters. He describes the risks of deterrence and the existential nature of the effects of nuclear war on human life and civilization. He proceeds to pull it all together, applying the law to the facts and demonstrating that known nuclear weapons effects cannot comply with such legal requirements as those of distinction, proportionality, necessity, precaution, the corollary requirement of controllability, and the law of reprisal. Moxley shows that, when the United States goes to apply international law to potential nuclear weapons uses, it distorts the law as it has itself articulated it, overlooks law in such areas as causation, risk analysis, mens rea, and per se rules, and disregards known risks as to nuclear weapons effects, including radioactive fallout, nuclear winter, electromagnetic pulses, and potential escalation. He then shows that the policy of deterrence is unlawful because the use of such weapons would be unlawful. Moxley urges that the United States and other nuclear weapons States take heed of the requirements of international law as to nuclear weapons threat and use. He argues that law can be a positive force in society’s addressing existential risks posed by nuclear weapons and the policy of nuclear deterrence.

The methodology deployed in this book, which is referred to as complementation or complementary application, represents a novel approach by focusing on commonly shared objectives and a unifying ordre public transnational across fields of public international law that allow for a harmonization beyond traditional treaty interpretation. Fields of public international law, mainly the laws of armed conflict, international environmental law, and human rights law, apply simultaneously to questions regarding the environment and war. Such a coexistence challenges the unity of the international legal order, and it also challenges the means of harmonization across fields of public international law. However, eventually, the co-existence of several fields of public international law can result in a refinement of international law and enhanced legal protection. Diversification can also contribute to clarification or normative intensification in areas of parallel application of various fields and multilayered legal protection, demonstrating a counter-option to fragmentation.

First, I examine the process and type of erosion taking place. I expand the existing debate and show that the erosion is not defined in monetary terms but in terms of the declining U.S influence within the established rule-based international order. Secondly, I use China and Russia as case-studies to define the present geopolitical rivalries and the (re)emergence of revisionist powers. Both China and Russia aim to shape the emerging international order and threaten the U.S. national security with the increased inter-state competition. Thirdly, I employ the techniques of discourse, document and graph analyses to draw conclusions about the various factors contributing to the erosion. These factors can be divided into two broad categories: the categories of internal and external factors. The internal factors encompass the U.S force posture in terms of its hardline policies as well as the increased concentration within the U.S military industrial complex which curbs competition and innovation and leads to controlled government contracts and the prioritization of corporate interests over national security interests. The external factors include the present global "disorder" characterized by inter-state competition, mainly Russia's military advancement in the global defense industry and China's expansionist economic and military agenda. China's case-study concludes that its Belt Road Initiative is used as an economic tool for military expansion into various regions of Asia, Middle East and Africa. On the other hand, Russia's case-study makes the connection between its increased market share in the global defense industry hampering U.S defense corporations' arms sales and its challenge to the U.S influence in global affairs. While Russia provides a cost-conditionalities benefit to non-NATO members in its arms sales, it also seeks to impact the future of the U.S. relationship with NATO, which contains military implications for Europe as well as for the global order. Lastly, this thesis analyzes the shifting of alliances and the process of the formation of a new-world order in which the U. S. military superiority is at stake. It concludes that there is a way back for the United States to restore and sustain its global military edge based on the framework defined in my research. The findings and strategies outlined for restoration are subject to certain conditions and limitations which can determine the fate of the U.S. military might.
