Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law and the Woman By study and comparison of the laws of the several States in their relation to women may be evolved such legislative measures as will tend to establish a fair legal status for women, which would mean a government of the people, for the people and by the people, along with the concession that women are people. The power is vested in the legislatures of the several States to make, ordain and establish all manner of laws, statutes and ordinances not repugnant to the Constitution and deemed for the best good and interest of the Common wealth. It is by and through these law making bodies women must establish their protective and defensive measures and these measures should be so fair, sane and equitable as to command universal respect and confidence. Careful and intelligent progress by women in the shaping of such new laws as are intended to equalize their status with the male citizen will best demonstrate their right to citizenship with its resultant obligations and duties, for in the multiplicity of laws now cluttering our statute books a few more, unless direct, forceful and valid, will but add to the confusion and defeat their purpose. It may be well to recall the fact that in 1913 more than two thousand bills were introduced in the Wisconsin legislature, of which eight hundred and twenty three were passed. The law making bodies of other States stagger, session after session, under equally heavy burdens. Wherefore it would seem that a Bureau of Legislation, with women fairly represented, to which all bills would have to be submitted for approval before introduction. Book excerpt: Excerpt from The German Judiciary But the displacement of the various state judicial systems by one common system for the whole empire by no means exhausted the constitutional power of the imperial legislature on the subject. It still had power to enact legislation with regard to notes and obligations and to create codes of commercial and criminal law and judicial procedure, which, when enacted, would supersede those in existence in the several states.3 After a considerable struggle 'a constitutional amendment was carried in 1873, which gave the imperial legislature still further power over the whole civil and criminal law and judi cial procedure.4 With this commission the legislature entered anew upon the task of unifying and nationalizing the private and criminal law and judicial procedure for all the German states. The completion of this task, thirty years after the founding of the empire, is an achievement unparalleled in legal history. In the end it was undeniably demonstrated that the people could be trusted - that the rank and file always will act upon accurate information as to the public character of candidates; that if the actual record of any aspirant for public position is placed before the people, they will elect or defeat him according to the measure of his merit and their own welfare. Back of the political phases of such work, lies the deeply funda mental element of enlightenment, education. Book Conflict of Laws Classic Reprint

Download or read book Conflict of Laws Classic Reprint written by John P. Tiernan and published by Forgotten Books. This book was released on 2017-10-11 with total page 136 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Conflict of Laws There are three general systems of legal instruction in use in American Law Schools - the lecture, the case, and the text method. Regardless of the relative superiority of one to the others, the author is convinced, after seven years teaching experience, that no one of these methods alone is adequate to sound, thorough instruction in the law. In his presentation of this difficult subject in the class-room, he has produced satisfactory results only by a combination of text, cases, and lecture in proper pro portion. The value of a text in stating the principles of the 1a7 in brief form can not be denied. The necessity of reading leading decisions that support and apply those principles is indisputable. And finally, there is the general discussion in class; the Instructor When neces sary, expounding the subject, imparting the benefits of his knowledge and experience and observation, thereby arousing and sustaining interest in the work; these are the things that elevate instruction from the mechanical to the intellectual. In presenting this text therefore, the author makes no defense. He has embodied the fundamentals of the sub jeot in the text in simple form. He has scrupulously selected the leading decisions and included them in the notes, Where they are identified by large conspicuous cita tion. Finally, instead of merely stating the law, he has by clear simple language explained it, so as to reproduce, as far as possible, the full value of the class instruction. It is this very feature, it is believed, that Will commend it for Law School purposes to Instructor and class alike. Book Supplement to the Law of Mechanics Liens

Download or read book Supplement to the Law of Mechanics Liens written by Frank James and published by Forgotten Books. This book was released on 2018-02-14 with total page 606 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Supplement to the Law of Mechanics' Liens: Upon Real Property of the State of California; Including All Amendments to the Mechanics' Lien Law of California and All Decisions of the Supreme Court, to December, 1901 The design of the author in writing this book has been to collate the statutes, and the decisions of the courts, of California relating to the liens of mechanics and others upon real property, and to make such comments and to give such explanations as seemed to be necessary for a clear and comprehensive understanding of the present law. It is intended to be a book of ready reference for use by practic ing lawyers rather than a labored essay for the entertain ment of the literati of the profession. Keeping these pur poses constantly in view, the inviting fields of speculation have been shunned and the splendid opportunities for learned disquisitions upon constitutional law have been passed unnoticed. The book shows the law as it is, and the legislative department of our government has not been invaded by the author's royal prerogative of decreeing for all time what the law ought to be. The need of such a work is known to every lawyer who has had occasion to draft a building contract or a claim of lien, or who has found it necessary to construe the pro visions of the lien law. This book was released on 2018-01-07 with total page 590 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Brief Making and the Use of Law Books The failure Of the law schools to turn out graduates better prepared for the practical work of the office or court-room is an old and ever recurring theme of complaint from bench and bar. The recent graduate himself, wrestling with his earliest practical problems, is especially prone to lay his troubles at the door of the law school. Without stopping to inquire in what other directions the law school has come short of its duty to the student, law teachers generally must concede that while a knowledge of law books and their use - in short, brief-making, in its broader sense is an essential professional acquirement, this field is yet, for the average law-school graduate, a vast waste of uncharted and unexplored territory. Following precedent, the teacher has been content to lay before the student, in the form of lectures, text-books or cases, or these combined, principles of the teacher's own choosing; but little or no necessity for sus taining or combating a particular proposition by written argu ment is encountered by the student while in the law school. The result has been that the student enters upon the practice. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Popular Law-Making: A Study of the Origin, History, and Present Tendencies, of Law-Making by Statute In order to understand, therefore, what a statute is, and why it has grown important to consider statute-making, it is necessary to have some knowledge of the meaning of the word law, and of the origin both of representative govern ment and of legislatures, before we come to statutes, as we understand them; for parliaments existed centuries before they made statutes as we now use this word. Statutes with us are recent; legislatures making statutes are recent every where; legislatures themselves are fairly recent; that is, they date only from the end of the Dark Ages, at least in Anglo Saxon countries. Representative government itself is sup posed, by most scholars, to be the one invention that is peculiar to the anglo-saxon people.
