This is perhaps because Human Rights scholars have different opinions about the concept. Human Rights are “generally moral rights claimed by everyone and held against everyone, especially against those who run social institutions’’, (Orend 2002 ). At the global stage, the United Nations (UN) has for years played a leading role in promoting and protecting human rights with support from International Non-governmental Organisations. In addition to the effort of the United Nations (UN), the state has basically been seen as the main actor in the promotion and protection of Human Rights. Unfortunately, states according to Hakemulder et al (1998), are often the very abuser of the rights of the citizens they are required to protect. It is noteworthy however that though the state bears the primary responsibility in issues of human rights, other organs of the society are included in the protection and promotion of Human Rights, (Addo, 1999). These organs, institutions and mechanisms include constitutions, law and legality, the courts among others. This write-up is about to discuss one of such mechanisms, the mass media in relation to how it carries out it promotion and protection role of Human Rights. Although there are International Human Rights Instruments which the United Nations (UN) has produced to serve as common standard of achievement of all people, countless Human Rights Violations occur locally and across the globe. These violations could be committed by the state as well as non-state actors. Non-state actors violate people’s Human Rights through direct involvement or indirectly when they consent to such violations. Non-state actors such as individuals, groups, informal or organized, ad hoc or continuous, may pose as violators, protectors or intermediaries.

However, the power of the media can also be misused to the extent that the very functioning of democracy is threatened. Some media outlets have been turned into propaganda megaphones for those in power. Others have been used to incite xenophobic hatred and violence against minorities and other vulnerable groups. Now the phenomenon of social media presents us with a range of fresh challenges. Blogs, video and social networking sites have become a key forum for political debate and organisation - so much so that they have provoked counter-responses from some repressive states. While there is a need to ensure better protection of personal integrity in social media, the right to freedom of expression must not be undermined. The purpose of this publication is to contribute to a more thorough discussion on media developments and their impact on human rights in a constantly changing media landscape. Eight experts were invited to contribute their personal assessments of trends and problems. They have not shied away from addressing controversial issues or providing far-reaching suggestions. Together their texts indicate that there is a need for stronger protection of media freedom and freedom of expression in Europe today. These are clearly topics of paramount importance which demand serious public debate.

Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary. In the context of an effective democracy and respect for human rights mentioned in the Preamble to the European Convention on Human Rights, freedom of expression is not only important in its own right, but it also plays a central part in the protection of other rights under the Convention. Without a broad guarantee of the right to freedom of expression protected by independent and impartial courts, there is no free country, there is no democracy. This general proposition is undeniable. This handbook is a practical tool for legal professionals from Council of Europe member states who wish to strengthen their skills in applying the European Convention on Human Rights and the case law of the European Court of Human Rights in their daily work.

For some, human rights stretch back to the dawn of Western civilization, the age of the American and French Revolutions, or the post–World War II moment when the Universal Declaration of Human Rights was framed. Revisiting these episodes in a dramatic tour of humanity’s moral history, The Last Utopia shows that it was in the decade after 1968 that human rights began to make sense to broad communities of people as the proper cause of justice. Across eastern and western Europe, as well as throughout the United States and Latin America, human rights crystallized in a few short years as social activism and political rhetoric moved it from the hallways of the United Nations to the global forefront. It was on the ruins of earlier political utopias, Moyn argues, that human rights achieved contemporary prominence. Every UN member state has ratified at least one of these treaties, making them applicable to virtually every child, woman or man in the world - over six billion people. At the same time, human rights violations are rampant. The problem is that the implementation scheme accompanying the core human rights standards was drafted during a period of history when effective international monitoring was neither intended nor achievable. Today there is a gap between universal right and remedy that is inescapable and inexcusable, threatening the integrity of the international human rights legal regime. There are overwhelming numbers of overdue reports, untenable backlogs, minimal individual complaints from vast numbers of potential victims, and widespread refusal of states to provide remedies when violations of individual rights are found. This landmark Report prepared by Professor Bayefsky envisions a wide-ranging number of reforms, most of which can be accomplished without formal amendment. The recommendations generally assume a six treaty body regime, and focus primarily on offering concrete suggestions for improvements in working methods of the treaty bodies and procedures at the Office of the High Commissioner for Human Rights (OHCHR). Professor Bayefsky details numerous proposals for bolstering national level partnerships, and for following-up the output of the treaty monitoring system as a key missing component of the implementation regime. One major reform requiring amendment is ultimately recommended, namely, consolidation of the human rights treaty bodies and the creation of two permanent committees, one for the consideration of state reports and one for complaints. They are omnipresent and frequently keep us company in our daily routine. Media products could not be more diverse: they range from newspapers and countless other written products over radio- and television broadcasting to the internet, video games, and motion pictures. Their diversity as well as their consistent further development make mass media a fascinating field of investigation, and there are more and more schools and universities across the globe which concentrate on mass media, its history, its future prospects, and various other aspects. The influence attributed to media constitutes a controversial topic. While fulfilling numerous valuable functions, such as circulating information and thereby contributing to education, there might also be some negative effects resulting from exposure to certain means of mass communication, which at this point can only be speculated. In recent years, following some shocking high school shoot-outs , media effects have become a widely-discussed topic and hence attracted lots of public attention. Do acts of violence seen on television or depicted in video games have a wider impact on adolescents than on adults? As a matter of fact, the media themselves contribute to their own disreputability by making trivialised statements about their direct influence on youths’ demeanour (Bonfadelli 2004: 9). But aside from this rather explosive issue, how do media influence adolescents’ daily life, e.g. their language use? Schlobinski and his research fellows Kohl and Ludewigt raise this question in their essay’s introduction (1993: 149). In the past, media were frequently accused of having an enormous influence on adolescent language use: Neil Postman’s works (1982; 1985) are mentioned, which basically blame the media for ‘polluting’ young people’s language, causing intense discussions about this topic (Schlobinski/Kohl/Ludewigt 1993: 149).
