Book excerpt: Excerpt from Old Maryland Manors, Vol. 7: With the Records of a Court Leet and a Court Baron A striking contrast between the North and the South is presented by the small landholdings of the former and the great estates of the latter. Tracts of thousands of acres were not at all uncommon in colonial Maryland, and sometimes land-grants included even tens of thousands. These great estates had a strong shaping influence on the life of early Maryland. Separating their owners by wide intervals, they prevented that association of interests and feelings that was strong in the towns of the northern colonies. The man who lived in the center of a tract of ten thousand acres must necessarily have been thrown largely upon his own resources for amusement and for culture. The cooperation which makes schools and libraries of easy attainment in a thickly settled community was absent among such people. Consequently education could be obtained only at great cost and inconvenience. The planter who was determined to have his children well taught had to send them abroad, as was done in the case of Charles Carroll of Carrollton. There were some towns founded in Maryland, it is true, in the earliest days. The vanished city of St. Mary's, the lost Joppa, and others that have disappeared as completely as the "cities of the plain," furnished a stimulus to civilization in some parts of the colony. But in spite of these instances, it is true that most of the life of Maryland in the latter half of the seventeenth and the whole of the eighteenth century, was country life. And it was a country life that presented many analogies to the country life of Englishmen during the same period. It was, perhaps, at its peak of importance in the thirteenth century. That allows some centuries during which it has survived, even if the authority Of its Courts has ceased. Customs in England die hard. At Warwick the Court Leet still is held every year and sometimes a presentment is made at it. The new Law of Property Acts have overhauled tenures, descent, and the conveyancing which have come down to us from our previous systems and in particular the tenure by copy of the Court Roll of the Manor is to be brought to an end within a fixed limit of time, ten years from the commencement of the Law of Property Act, 1922. The Manorial documents - which include Court rolls, surveys, maps, terriers, documents and books of every description relating to the boundaries, franchises, wastes, customs or courts of a manor, whether in being on lst January, 1926, or Obsolete, but do not include the deeds or other instruments required for evidencing the title to a manor, - are thus no longer needed. When a closed register or document is laid aside, and is of no immediate use, its purpose, and the interesting material contained in it, is forgotten. Book excerpt: Excerpt from The Court Leet Records of the Manor of Manchester, Vol. 11: From the Year 1552 to the Year 1686, and From the Year 1731 to the Year 1846 In this volume, the last of the series, the proceedings of the Courts Leet of the Manor of Manchester are continued from the 8th October, 1832, to their conclusion on the 24th April, 1846. There is but little to comment upon in the entries in each Court, which are similar to those contained in the last volumes, and chiefly relate to the using of unfair weights, the selling of bad meat, and the discharge of too much smoke from chimneys. The non-attendance of persons summoned to serve as Jurors is commented upon at each Court, and on several occasions much difficulty was experienced in obtaining fit persons to serve the offices of Boroughreeve and Constables. Sir Oswald Mosley, Bart., was the lord of the manor during the period covered by this volume, and James Norris, Esq. (appointed in 1819), continued to act as Steward until the year 1836, when James Heath Leigh Esq., was appointed to that office, which he was holding when this volume ends. Mr. Samuel Kay, the Deputy-Steward, is also occasionally mentioned. During the period covered by this volume very great changes took place in the government of Manchester, owing to the borough being incorporated in the year 1838. As the history of this incorporation is one of a most interesting character, I have thought it would be very fitting to give an account of it here, so as to connect the government of the town in the past with that now in force. It was also owing to the incorporation of the borough and the subsequent purchase of the manorial rights in 1846 that the holding of the Courts Leet came to an end in that year, which is a further reason why, in this, the concluding volume of the series of the Court Leet Records, an account of the reasons for their discontinuance should be given.
