Book excerpt: Over 25 per cent of present day refugees enjoy asylum in Pakistan, most of them having been there for more than a quarter of a century. Pakistan is not, however, a party to either the 1951 Convention relating to the Status of Refugees or the 1967 Protocol relating to the Status of Refugees. The legal status of the Afghan refugees it hosts is therefore not a foregone conclusion, even though they were considered to be refugees on a prima facie basis during the first two decades of their exile in Pakistan. This article identifies the legal status of the Afghan refugees on the basis of a series of agreements Pakistan concluded with UNHCR and also occasionally with Afghanistan. By virtue of the last of the series of agreements, Afghan refugees can return to Afghanistan under a UNHCR-assisted voluntary repatriation programme until December 2009. In view of the fact that all Afghans have been granted leave to stay in Pakistan until the same date, many are expected to stay in Pakistan rather than return with the assistance of UNHCR. Unlike the preceding agreements, the last one does not address the fate of those who will still be in Pakistan upon completion of the voluntary repatriation programme. It seems therefore imperative to identify the legal status and corresponding entitlements of the Afghan refugees. It is argued that the prima facie recognition of refugee status can be sustained on the basis of the agreements referred to. In addition it is argued that the current lsquo;profiling' exercise of UNHCR, even while presumably beneficial for the most vulnerable refugees, is irreconcilable with the status and entitlements of the Afghan refugees, and the same holds true with respect to the usual practice of lsquo;screening' those refugees who have opted not to return under a voluntary repatriation programme. An alternative that would be reconcilable is a collective cessation of refugee status if and when the situation in the country of origin so warrants, provided individual refugees may contest this.

Book excerpt: This book provides a critical analysis of how the “war on terror” affected the civilian population in Afghanistan and Pakistan. This “forgotten war,” which started in 2001 with the US-led invasion of Afghanistan, has seen more than 212,000 people killed in war-related incidents. Whilst most of the news media shifted their attention to other conflict zones, this war rages on. Badalič has amassed a vast amount of data on the civilian victims of war from both sides of the Durand line, the border between Afghanistan and Pakistan. He conducted interviews in Peshawar, Quetta, Islamabad, Kabul, Jalalabad, and many other cities and villages from 2008 to 2017. His data is mostly drawn from those extensive conversations held with civilian victims of war, Afghan and Pakistani officials, human-rights activists and members of the insurgency. The book is divided into three parts. The first examines the impact the US-led coalition, Afghan security forces and paramilitary groups had on civilians, with methods of combat such as drone strikes and kill-or-capture missions. The second part focuses on civilian victims of abuses of power by Pakistani security forces, including arbitrary detentions and forced disappearances. In the final part, Badalič explores the impact of unlawful practices used by the armed insurgency – the Afghan Taliban. Overall, the book seeks to tell the story of the civilian victims of the “War on Terror".

Book excerpt: Partition and post-colonial migrations – sometimes voluntary, often forced – have created borders in South Asia that serve to oppress rather than protect. Migrants and refugees feel their real home lies beyond the border, and liberation struggles continue the quest for freedoms that have proven to be elusive for many. States scapegoat refugees as "outsiders" for their own ends, justifying the denial of their rights, while academic discourse on refugees represents them either as victims or as terrorists. Taking a stance against such projections, this book examines refugees’ struggles for better living conditions and against marginalization. By analyzing protest and militarization among refugees, the book argues that they are neither victims without agency nor war entrepreneurs. Through interviews, surveys, and statistical analyses, it shows how states have manipulated refugee identity and resistance to promote the ideal of the nation-state, thereby creating protracted refugee crises. This is evident even in the most humanitarian state intervention in modern South Asia – India’s military intervention in East Pakistan (now Bangladesh) in 1971. The findings put forward provide the basis to understand the conditions under which violence can break out, and thereby have implications for host countries, donor countries, and aid organizations in the formulation of refugee‐policy. The book is of interest to scholars in the fields of South Asian studies, comparative politics, international relations, refugee studies, development studies, security studies and peace studies.

This study goes beyond economic integration to present a detailed appraisal of cooperation under the overarching themes of economic cooperation, environmental security, human welfare, and cooperation in security matters. According to the author, SAARC is making progress in addressing the myriad of issues on its agenda. The transition from agreements to actions and frequent interactions among the member states has boosted confidence. The progress of SAARC is more evident in the less controversial areas of human security, such as poverty alleviation, health and safety, human resources development, and higher education. Notwithstanding enthusiastic commitments reflected in agreements and action plans, there is a gulf between rhetoric and implementation most notably in sensitive areas relating to traditional security. In the light of the findings of this study, the author proposes that greater cooperation in common human security areas has a potential to pave the way for a cooperation on issues of a ’contentious’ nature, particularly terrorism.

The regime that is currently in place has consequently lost its original structure and consistency. In particular, it is no longer a normative continuum, and as a result, the international protection of refugees is no longer secure but dependent on contingencies. The changes in the regime exclusively concern the mandate of UNHCR. The personal and substantive scope of its activities has been extended time and again with the consent of states as represented in the UN General Assembly. As those extensions have never been (considered to be) matched by corresponding obligations on the part of states, UNHCR's world has been turned into a parallel universe.
