Book excerpt: Excerpt from The Law of Interstate Commerce and Its Federal Regulation The purpose of this book is to present in a compact form the law of interstate commerce as declared by the courts since the adoption of the Constitution, and also as enacted by Congress and applied by the Interstate Commerce Commission in the direct exercise of the power of federal regulation. The book has been written under the conviction that the direct federal regulation of interstate commerce, though it only dates since the close of the Civil War, has come to stay. The rules declared by the Interstate Commerce Commission in the eighteen years of its existence, though its powers have been in some respects curtailed by the judicial construction of the Interstate Commerce Act, have made a body of administrative railroad law which seems properly included in a treatise of this character. Every phase of the complex adjustment of railway rates has been considered by the Commission, and their rulings in this infinite variety of cases have a permanent value in the solution of the transportation problems of the future. In the annotation of the Interstate Commerce Act it has been the aim to cite such only of the rulings of the Commission as are illustrative of the practical enforcement of the Act under the limitations of their powers as declared by the Supreme Court. The limits of the unexercised power of federal regulation can be intelligently considered, only with a clear apprehension of what the Supreme Court has declared in determining the line between federal and State authority, as with few exceptions the decisions of the Court in interstate commerce have declared what the States can and cannot do, and not what Congress can or cannot do. In view of the present agitation for the amendment of the Interstate Commerce Act, as well as for other new legislation in the regulation of interstate commerce, it is well to ascertain what has been done under federal regulation in the past and what can be done under existing laws in the future. Book excerpt: Excerpt from The Act to Regulate Commerce: Construed by the Supreme Court The Commerce Clause contains one of the most important grants of power to the United States to be found in the Federal Constitution. Adopted merely for the purpose of preventing disputes among the states which had recently formed the Confederation, it has been the source of varied and potent legislation governing the intricate problems of interstate traffic incident to a complicated and highly developed industrial and social life. Framed to suit the inconsequential problems offered by a traffic handled by stage coach, ox cart and sailing vessel, it has served as the vehicle to govern the important questions arising from an enormous volume of traffic handled by the railroad, the steamer, and other agencies of commerce. A preliminary chapter has been included to trace at least in outline the genesis and development of legislation under the Commerce Clause. The literature of the subject, both political and economic as well as legal, appears to be well nigh inexhaustible. Yet there has seemed room for a further discussion of certain features of the Act to Regulate Commerce. The findings of the Interstate Commerce Commission to date fill some thirty large volumes. The decisions of the lower Federal courts upon this act are only less voluminous. On the other hand, the decisions of the Supreme Court which constitute the last word on the question, and from which no appeal can be taken, have often not been treated by writers on this subject with the measure of importance which should be accorded them. Many of the most important of these decisions have been handed down by that court since the appearance of any treatise on this act. It has seemed desirable, therefore, to collate these decisions, to include an exhaustive discussion of them within the confines of a single volume and to bring them down to the latest possible date. Such a volume could be of particular value to the lawyer who does not have at his disposal a large legal library. It would constitute the law of the Act to Regulate Commerce so far as that law has been finally determined. Decisions of the lower courts, subject to review and, therefore, to being overruled, have been omitted from discussion in this work. It is hoped that the volume will fill a place hitherto unoccupied in the bibliography of the Act to Regulate Commerce. Book excerpt: Excerpt from The Law Relating to the Interstate Commerce Commission: Sherman Anti-Trust Act; Bureau of Corporations It will conduce to a clearer understanding of "The Act to Regulate Commerce" to give a brief outline of its general scope, with the object of fixing the rights which it was intended to conserve or create, the wrongs which it proposed to redress and the remedies which the Act established to accomplish the purposes which the lawmakers had in view. The causes which induced the enactment of the statute grew out of the use of railroads as the principal modern instrumentality of commerce. While shippers of merchandise are under no legal necessity to use railroads, they are so practically. The more valuable articles of traffic demand speedy and prompt movement, and the immense outlay of money required to build and maintain railroads, and the necessity of resorting, in securing the rights of way, to the power of eminent domain, in effect disable industrial merchants and shippers from themselves providing such means of carriage. From the very nature of the case, therefore, railroads are monopolies, and the evils that usually accompany monopolies soon began to show themselves and were the cause of loud complaints. The chief complaint of the public was that from the mode in which the carriers imposed their charges it resulted that the rates were unequal; that to make good the loss resulting from the favoritism shown to particular localities, persons, or classes of business, a greater burden was placed upon the remainder of the traffic; and that through the practical monopoly acquired by the railways over the transportation business of the country the shippers were largely at the mercy of the carriers, and that as a result the business of the community, in so far as the same depended upon the use of transportation facilities, was subjected to unequal and unreasonable burdens and exactions.
