Available in PDF, EPUB and Kindle. Book excerpt: Scamell and Gasztowicz on Land Covenants, 2nd edition, brings the material up to date, exploring the types of covenants practitioners have to contend with, and seeking to offer practical advice in this complex and far reaching area of law. The second edition includes coverage of positive covenants and planning covenants which no other title on the market currently offers. A covenant can be either positive or negative. It is important to understand the difference between positive and negative covenants as not all covenants are enforceable and different rules on enforceability apply depending on whether the covenant is positive or negative. Dealing with the impact of Covenants on land affects most conveyancing transactions and is also of vital importance to landowners, developers and others. It is a complex and broad area of law for property lawyers to contend with. The volume of case law on this topic is extensive. Scamell and Gasztowicz on Land Covenants, 2nd edition, is divided into three main parts: Part I – Restrictive Covenants; Part II – Positive and Negative Covenants; Part III: Planning Obligations. It also deals with the special position of local authorities in relation to land covenants, and has comprehensive coverage on freeing land from restrictions.

Book excerpt: This unique book provides practical and legal clarity on all questions concerning landlord's consent, such as: What is a valid and effective request for consent? When can a tenant impose its desire for change on a reluctant landlord? What is a reasonable as opposed to an unreasonable refusal of consent? And what are the perils if either side calls it wrong? Since the last edition of this book in 2008, the law relating to landlord's consent, has evolved considerably. The purpose of this new edition is to bring that evolution into the much-loved analysis which have made practitioners say that previous editions have been that rare beast: a book about law that is actually enjoyable to read and which allows the practitioner and student clearly to see the wood for the trees.
Download or read book A New Landlord and Tenant written by Peter Sparkes and published by Bloomsbury Publishing. This book was released on 2001-02-13 with total page 972 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is designed to complement the author's A New Land Law,integrating with that work in its simplified terminology, and emphasising a three-fold functional classification of leases – short residential tenancies, long residential leases and commercial leases. Rented housing is treated as a unified whole, with particular prominence being given to shorthold arrangements. The book includes reference to the changes to the allocation and homelessness regimes proposed by Part II of the Homes Bill 2000. It also considers the impact of the Human Rights Act 1998, the changes to repossession procedures implemented by the Woolf Reforms, and the year 2000 bumper crop of decisions on housing law. Leasehold tenure is undergoing dramatic changes. The book draws a functional distinction between long residential leases and rental arrangements, based on the registrability of long leases, their freedom from rent controls and security of tenure, special controls of management and forfeiture, and enfranchisement rights. Extensive coverage is given to the Commonhold and Leasehold Reform Bill 2000, introduced into the House of Lords in December 2000, and promising improvements in the enfranchisement schemes, additional management controls, and a commonhold scheme. Topics on commercial leases (business and agricultural) given special attention include the reasonable recipient principle for the construction of notices, a decision on the effect on a sub-tenant of an upwards notice to quit by his head tenant, and Law Commission proposals on the Termination of Tenancies (1999).

Available in PDF, EPUB and Kindle. Book excerpt: During the year the Commission published five reports, making recommendation in areas as diverse as criminal conspiracy, consumer insurance and trust law and launched 11 consultations. The Commission was pleased to see the implementation of their recommendations in their reports on Reforming bribery as contained in the Bribery Act; Capital & income in trusts: classification & apportionment; and Murder, manslaughter and infanticide. However the Commission was disappointed with the then Government response to the report on Damages as contained in the draft Civil Law Reform Bill and the decision not to proceed with their work on Limitation. Also for the first time this year the Commission staged an exhibition in the Houses of Parliament to raise their profile.
Download or read book Annual Report 2008 09 written by Great Britain. Law Commission and published by Law Commission Reports. This book was released on 2009 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: To date the Law Commission has produced 180 final reports recommending reforms. Of these 135 have been implemented either wholly or in part. 12 await a decision from the Government. While this is impressive, the speed of implementation has been a cause of concern. The first step to improve this was the amendment of the Law Commissions Act of 1965 to provide that the Chair of the Commission must be a judge of the High Court or of the Court of Appeal. The next significant development was the introduction of the Constitutional Renewal White Paper which brings forward proposals to place a statutory duty on the Lord Chancellor to report annually to Parliament on outstanding Law Commission recommendations. The Constitutional Renewal Bill has yet to be introduced. These and other changes; and reports and papers published during the year are outlined.
