Book Online Family Dispute Resolution

Download or read book Online Family Dispute Resolution written by Elisabeth Wilson-Evered and published by Springer Nature. This book was released on 2021-01-12 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book brings together the expertise of two authors involved in initiating the development of Online Family Dispute Resolution (OFDR), while also examining the unique Australian system. The family arena generally comprises property or child-related disputes arising between parents, whether married or not, and whether the parties have lived together or not. A special feature of Australia’s OFDR system is that it deals with children’s issues rather than focusing on property distribution. The book first discusses how technological innovations have transformed dispute resolution services to families. It explores the need for OFDR and how such systems can potentially be implemented. In turn, the coverage shifts to screening tools used prior to a Family Dispute Resolution session to ensure that online systems are appropriate for the case under dispute and the people involved. Readers will then learn about the necessary training required – for administrators, practitioners and clients alike - for OFDR to be successful. In addition, the book offers a comprehensive evaluation of the system and reflects on the lessons learned to date. In closing, it suggests ways in which OFDR could be further developed and applied to family disputes around the world.

Book The Voice of a Child in Family Law Disputes

Download or read book The Voice of a Child in Family Law Disputes written by Patrick Parkinson and published by OUP Oxford. This book was released on 2008-12-18 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: When relationships break down, disputes commonly arise over the parenting arrangements for children, whose living arrangements have to be reorganized at a time of great conflict and turmoil. Most such disputes are resolved without a judicial determination through private agreement, negotiation between lawyers, mediation, or a combination of these methods. This book examines whether and how children should be involved in the process of resolving family law disputes. Although there is widespread acceptance in the Western world that the views of children should be taken into account, and that the weight given to those views should depend on their age and maturity, there is much less agreement about how children's voices should be heard. There are many benefits to giving children a voice in decisions that affect their lives, and the UN Convention on the Rights of the Child identifies this as a right for children. However, there are difficulties and dangers in seeking to hear from children, not least because they may be subject to pressure from each parent to express views that support his or her case. Courts dealing with family law issues are constantly faced with a dilemma. Is it better to keep children out of the conflict, or to give them a say, so that the arrangements are as workable for them as possible? This book integrates examinations of these issues with empirical data from interviews which explore the views and experiences of children, parents, counsellors, mediators, lawyers, and judges involved in such disputes in Australia. Drawing on this research, the authors suggest ways in which children can better be heard without placing them at the centre of their parents' conflicts. They argue that the focus should not just be on how children are heard in legal proceedings, but on how they can be better heard in those families who resolve their conflicts without going to court.

Book Sheila

Download or read book Sheila written by Lloyd Davies and published by Desert Pea Press. This book was released on 2000 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1933, Sheila McClemans and Molly Kingston, refused employment elsewhere, set up Western Australia's first all female law firm. Sheila went on to become one of the State's most distinguished daughters. She was wartime director of the Women's Royal Naval Service; national president of the Australian Federation of University Women; secretary of the WA Law Society; and foundation member of the WA Legal Aid Commission, of the State Parole Board, and of the WA committee administering the Commonwealth Canteens Trust Fund. She was awarded an OBE, a CMG, and the Silver Jubilee Medal. But she was denied the traditional rewards of the legal world. Not QC, not Judge, not Dame. Not even pre-selection for MP. This is Sheila's story. Feisty, entertaining, outspoken, Lloyd Davies does full justice to a remarkable story.
