Book excerpt: Excerpt from The Law and Practice of the Courts of the United Kingdom Relating to Foreign Judgments and Parties Out of the Jurisdiction: To Which Are Added Chapters on the Laws of the British Colonies, European and Asiatic Nations, and the States and Republics of America A first edition can scarcely pretend to be more than a sketch of any subject: in the second, the author may hope to arrive at more perfect and finished work. In recasting and rewriting the volume published in 1879, I have therefore attempted a deeper analysis of the subject which a more prolonged study of the cases rendered possible. In doing this I received many valuable suggestions from my friend Mr H. Duff of the Inner Temple. The volume published in 1881 reappears as chapters xii to xvi of the present work: these chapters preserve their original form, which kept convenience of reference principally in view. A considerable amount of information has been added to them, and many serious omissions have been supplied. To a member of the Reichsjustizamt at Berlin, one of the most erudite of German judges, Mr Landrichter Vierhaus, who has been my unwearying correspondent during the last eighteen months, I am indebted for much of this additional information, and for the entire chapter on German law. Without his valuable aid even an approach to completeness would have been impossible. I am also under a debt of great obligation to Mr Ernest Schuster, of the Middle Temple, who has laboured unceasingly in my behalf in the collection and translation of foreign laws. Available in PDF, EPUB and Kindle. Book excerpt: With increased international trade transactions and a corresponding increase in disputes arising from those transactions, the application of the doctrine of Forum Non Conveniens - the discretionary power of a court to decline jurisdiction based on the convenience of the parties and the interests of justice - has become extremely relevant when determining which country's court should preside over a controversy involving nationals of different countries. Forum Non Conveniens: History, Global Practice, and Future Under the Hague Convention on Choice of Court Agreements provides an in-depth analysis of the common law doctrine of Forum Non Conveniens as it has evolved in the four major common law countries (UK, US, Canada, and Australia), and looks at the similarities and differences of the doctrine among those four countries. It compares Forum Non Conveniens to the more rigid analogous doctrine of Lis Alibi Pendens found in civil law countries, which requires automatic deference to the court where a dispute is first filed and explains current initiatives for coordinating jurisdictional issues between the common law and civil law systems, the most important of which is the 2005 Hague Convention on Choice of Court Agreements. The authors explain how the Hague Convention provides a rational approach to the confluence of common law and civil law doctrines and how its application to international transactions is likely to temper judicial application of the doctrine of Forum Non Conveniens and provides greater predictability with respect to enforcement of private party choice of court agreements.Forum Non Conveniens: History, Global Practice, and Future Under the Hague Convention on Choice of Court Agreements is the only book to provide a complete explanation of Forum Non Conveniens in the context of global litigation, making it a very important resource and reference work.

Download or read book The Conflict of Laws written by Adrian Briggs and published by OUP Oxford. This book was released on 2008-05-08 with total page 325 pages. Available in PDF, EPUB and Kindle. Book excerpt: Could you sue in England if you made a contract with someone overseas, or if you had an accident overseas? If you were to sue in England in one of these cases, which country's laws would be applied? Would you have anything to worry about if you were sued overseas but didn't intend to go back to the country concerned? Could you take steps in England to stop someone suing you overseas? The Conflict of Laws provides a complete yet accessible survey of English private international law. It examines the jurisdiction of English courts (and whether their judgments are enforced and recognized overseas) and the effect of foreign judgments. It looks at the principles of choice of law for cases with an international element, for example contracts made or performed in other jurisdictions or with other parties, torts committed overseas or by foreign parties, international fraud, dealings with property overseas, and family and personal matters (including marriage, divorce, and financial support) across different jurisdictions. As the law becomes less 'English' and more 'European', real and difficult questions arise at the point where two sources of legislative authority, and two streams of judicial authority, come together. This fully updated second edition explores how these changes are altering the foundations of the subject. In the established tradition of the Clarendon Law Series, The Conflict of Laws is both an introduction to the subject and a critical consideration of its central themes and debates.
