The author has used great freedom in criticizing the de cisions of courts, and the opinions of judges and jurists, of the highest authority; and he is quite aware, that, by a proceeding so unusual to the English writers on law, he has exposed himself to the charges of temerity and presumption. He believes, how ever, that he has, in no instance, questioned the propriety of a decision, or the soundness of an opinion, without submitting to his readers, the grounds and motives of his dissent; and if the reasons that he has given, are not lightly advanced, he is firmly persuaded, that to express the dissent they are meant to justify, was a duty, that may be inadequately performed, but could not he declined.
