Book The Law of the Employment of Labor Classic Reprint

Download or read book The Law of the Employment of Labor Classic Reprint written by Lindley Daniel Clark and published by Forgotten Books. This book was released on 2017-09-12 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of the Employment of Labor A recognized pressing need of the social organization is the securing of safe and wholesome conditions of work and an ad justment of the relations of employer and employed in the light of their mutual and reciprocal rights and interests, so that there shall be neither undue advantages nor undue burdens on either side. It is not many years since such legal provision as existed was embodied solely in the common law, that body of customs and adjudications that had come to have the sanction of the courts of England and America to such an extent that it became a clog to any progressive adjustment of law to changing eco nomic conditions. Clearly a policy shaped in the days of the hand loom and forge and transportation by horse power could poorly provide for the needs of industry to - day. The common law reduced to a codified form is printed as an appendix to this volume, and sufficient evidence of its inadequacy is afforded if this code is compared with the scores of statutes compiled in the fifteen-hundred-page volume of labor laws, forming the Twenty second Annual Report of the United States Commissioner of Labor, presenting the enactments of the legislatures of the various states in their attempt to prescribe the respective rights and duties and to safeguard the physical and economic interests of the parties to the labor contract. There is a feeling, only too well founded, that, despite legislation, the dead hand of outgrown doctrines of the common law restrains the courts in their con struction of statutes; but that there is encouraging advance in this respect cannot be gainsaid. One of the most important functions of a State department which has the range of topics granted to this Bureau is the consideration of pertinent questions which are liable to become subjects of legislation and upon which legislators desire information. The Act under which the Bureau is formed has its limitations - Q - it might well be amended so as to enlarge the plan and scope of the department, but even under its present fundamental law investigations of such a nature as we have outlined and of the character Which appear in the following pages, seem to be fully warranted. All of the subjects considered bear directly upon the daily life and well being of the great mass of working people of the State, and thus the'bureau has been enabled to aspire to the accomplishment of several purposes. It endeavors to furnish food for thought by the toilers in the various forms of manual industry and material for consideration by those who desire the advance of their fellows, as well as lawmakers who represent the people and have the interest of the State and its citizens at heart. Book Report of the Connecticut State Commission on Compensation for Industrial Accidents Classic Reprint

Download or read book Report of the Connecticut State Commission on Compensation for Industrial Accidents Classic Reprint written by Talcott H. Russell and published by . This book was released on 2016-06-21 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Report of the Connecticut State Commission on Compensation for Industrial Accidents It must be borne in mind also that in this country many of the employes in large industrial establishments are engaged in a class of labor for which the compensation is barely sufficient for their support and that of their families. In such cases it is increasingly difficult to accumulate savings sufficient to provide for their fami lies in case of death or incapacity for labor, either temporary or permanent. Humanity, therefore, would seem to demand that some provision should be made for the results of accidents under such circumstances. Aside from considerations of humanity, the public has a direct interest in the matter. An accident causing incapacity for labor, or death, is an injury to the public, for through such accident the capacity of the workman to support himself and his family is so far affected that they may become wholly or in part a burden to the public. Book excerpt: Excerpt from A Selection of Cases and Other Authorities on Labor Law In regard to the cases cited in the footnotes the effort has been made not to give exhaustive collections of decisions, but rather to cite a few leading authorities or suggestive decisions, in the belief that the latter will prove more stimulating and helpful to the student than encyclopaedic collections of cases. An appendix containing figures on minimum budgets for workingmen has been added for the convenience of those who are studying the question of the living wage as worked out in some of the decisions appearing in Chapter XIX by the Australian Court of Conciliation and Arbitration and the Kansas Court of Industrial Relations. It is hoped that this collection of cases may also prove useful as a source book to all those, whether in the ranks of employers or employees, who are interested in studying the development and application of the legal principles underlying the growing mass of decisions which make up the body of labor law.
