Book excerpt: Malaysia's constitution was set at the independence of the Federation of Malaya in 1957 along the lines of the Westminster model, embracing federalism and constitutional monarchy. That it has endured is explained in terms of the social contract agreed between the leaders of the three main ethnic groups (Malay, Chinese, Indian) before independence. However, increasing ethnic tension erupted in violence in 1969, after which the social contract was remade in ways that contradicted the basic assumptions underlying the 1957 Constitution. The outcome was an authoritarian state that implemented affirmative action in an attempt to orchestrate rapid economic development and more equitable distribution. In recent years constitutionalism, as enshrined in the 1957 Constitution but severely challenged during the high-authoritarianism of Prime Minister Tun Dr Mahathir Mohamad's developmental state, has become increasingly relevant once again. However, conflict over religion has replaced ethnicity as a source of discord. This book examines the Malaysian approach to constitutional governance in light of authoritarianism and continuing inter-communal strife, and explains the ways in which a supposedly doomed colonial text has come to be known as 'our constitution'.

Immigration is restricted, and Brunei’s hydrocarbon wealth is invested conservatively, mostly outside the country. Today home to some 393,000 inhabitants and comprising 5,765 square kilometers in area, Brunei first appears in the historical record at the end of the 10th century. After the Spanish attack of 1578, Brunei struggled to regain and expand its control on coastal West Borneo and to remain within the trading networks of the South China Sea. It later fell under British sway, and a residency was established in 1906, but it took the discovery of oil in Seria in 1929 before the colonial power began to establish the bases of a modern state. Ranking second (after Singapore) in Southeast Asia in terms of standards of living, the sultanate is implementing an Islamic penal code for the first time of its history. Book excerpt: Following the fall of the Melaka Sultanate to the Portuguese in 1511, the sultanates of Johor and Aceh emerged as major trading centers alongside Portuguese Melaka. Each power represented wider global interests. Aceh had links with Gujerat, the Ottoman Empire and the Levant. Johor was a center for Javanese merchants and others involved with the Eastern spice trade. Melaka was part of the Estado da India, Portugal's trading empire that extended from Japan to Mozambique. Throughout the sixteenth century, a peculiar balance among the three powers became an important character of the political and economical life in the Straits of Melaka. The arrival of the Dutch in the early seventeenth century upset the balance and led to the decline of Portuguese Melaka. Making extensive use of contemporary Portuguese sources, Paulo Pinto uses geopolitical approach to analyze the financial, political, economic and military institutions that underlay this triangular arrangement, a system that persisted because no one power could achieve an undisputed hegemony. He also considers the position of post-conquest Melaka in the Malay World, where it remained a symbolic center of Malay civilization and a model of Malay political authority despite changes associated with Portuguese rule. In the process provides information on the social, political and genealogical circumstances of the Johor and Aceh sultanates.
