Book National Mechanics Liens Handbook

Download or read book National Mechanics Liens Handbook written by James Acret and published by BNI Publications. This book was released on 1998-06-06 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents for the first time, the construction mechanics lien statutes of the fifty states and the District of Columbia. Also presented is the Miller Act, which requires payment bonds for the protection of subcontractors and suppliers on federal projects. The book was edited by James Acret, of counsel to Thelen Reid & Priest in Los Angeles, and recognized nationwide as a leading authority on construction law. Also included is Acret's Simplified Summary of the mechanics lien laws along with a treatment of stop notice and payment bond remedies. The catchlines to the statutes were also written by Acret.Since every state has its own mechanics lien statute, learning acquired in one state cannot be transferred to another without a careful study of its particular statute.Since most states impose preliminary notice requirements, a contractor, design professional, or material supplier can't afford to wait until after a collection problem arises to look up the applicable law. Likewise, developers, sureties, and construction lenders must take steps to protect themselves at the beginning of the development process rather than after payment problems have arisen. Developers, contractors, subcontractors, design professionals, building material dealers, construction lenders, and sureties will find this book indispensable.

MECHANICS' LIEN LAW OF WASHINGTON The lien of the mechanic, here treated of, is a remedy in the nature of a charge on land, given by statute to the persons named therein, to secure a priority or preference of payment for the performance of labor or supply of materials to buildings or other improvements, to be enforced against the particular property in which they have become incorporated, in the manner and under the limitations therein expressly provided. Brown v. Story, 4 Met. (Ky.) 316; Barrows v. Baughman, 9 Mich. 213. It is a mere incidental accompaniment as a means of enforcing payment--a remedy given by law, which secures the preference provided for, but which does not exist, however equitable the claim may be, unless the party brings himself within the provisions of the statute, and shows a substantial compliance with all its essential requirements. Bailey v. Mason, 4 Minn. 546; Elleson v. Jackson Water Co., 12 Cal. 542; Spencer v. Barnett, 35 N. Y. 96. The theory of the lien is, that the party furnishing materials for the erection or repair of buildings on credit retains his claim to them after they have gone into the building; and, to enable him to enforce it, his lien is spread over all the property with which the materials have become inseparably connected. Chapin v. Persse, 30 Conn. 461. The grounds of decision to be resorted to must be the general scope and spirit of the enactment, the analogy of cases which have already been settled, and such considerations of policy as may be supposed to have had their influence on the minds of the law makers, and to aim at such results as will most effectually promote the interest and security of those classes of men whom the system was designed to favor. Under the various sections of...
