Book excerpt: Excerpt from The High Court of Parliament and Its Supremacy: An Historical Essay on the Boundaries Between Legislation and Adjudication in England In my treatment of this subject I have tried to keep within the limits I set for myself at the begin ning. Though I have argued against historical views which seemed insufficiently supported by evidence, I have done so without considering the bearing of those arguments upon controverted questions of to-day. Our legal institutions, in'common with our other institu tions, may be looked at in two ways. Even men's high est religious beliefs and aspirations may in all proba bility be rightly traced back to instincts which are so elemental and low that they are shared by animals far down in the scale of life. By demonstrating this humble origin, and the gradual development out of it, some scientists have supposed that they were dispos ing of the claims of religion upon the attention of men. They have assumed that a judgement - to use Pro fessor William J ames's expression - which is purely existential has validity also as a proposition of value. Thus to mistake the history of an institution for its rational justification seems to me a confusion of the worst sort. Book Essays on the History of Parliamentary Procedure

Download or read book Essays on the History of Parliamentary Procedure written by Paul Evans and published by Bloomsbury Publishing. This book was released on 2017-12-28 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: 8 February 2015 marked the 200th anniversary of the birth of Thomas Erskine May. May is the most famous of the fifty holders of the office of Clerk of the House of Commons. His continued renown arises from his Treatise upon the Law, Privileges, Proceedings and Usage of Parliament, first published in 1844 and with its 25th edition currently in preparation. It is known throughout those parts of the world that model their constitutional arrangements on Westminster as the 'Bible of Parliamentary Procedure'. This volume celebrates both the man and his book. Bringing together current and former Clerks in the House of Commons and outside experts, the contributors analyse May's profound contribution to the shaping of the modern House of Commons, as it made the transition from the pre-Reform Act House to the modern core of the UK's constitutional democracy in his lifetime. This is perhaps best symbolised by its enforced transition between 1834 and 1851 from a mediaeval slum to the World Heritage Palace of Westminster, which is the most iconic building in the UK. The book also considers the wider context of parliamentary law and procedure, both before and after May's time. It constitutes the first sustained analysis of the development of parliamentary procedure in over half a century, attempting to situate the reforms in the way the central institution of our democracy conducts itself in the political contexts which drove those changes.

Book The British System of Government and Its Historical Development

Download or read book The British System of Government and Its Historical Development written by Christopher Edward Taucar and published by McGill-Queen's Press - MQUP. This book was released on 2014-11-01 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: The basic rules and implications of every state's system of government provide an authoritative and objective basis to guide and judge the actions of the state's decision makers, including courts. Christopher Taucar provides a detailed history of the British system's development from state power being exercised by centralized royal courts to its present-day distinct legislative, judicial, and executive bodies with diverse powers. The British System of Government and Its Historical Development fills a large and important gap in contemporary understandings of British legal and political history by providing a broad overview of a system that influenced political systems across the world. The main constitutional settlements are examined, including the development of parliamentary sovereignty, courts, and the common law, emphasizing the supremacy of law and natural law. Thus, the findings question the assumptions held by many contemporary scholars and judges by reaffirming the centuries-old view of the supremacy of law as an objective and external standard. The British System of Government and Its Historical Development argues that knowing this system is vital not only to our understanding of systems of government in Britain and elsewhere, but also as the basis to hold governments accountable to their most basic rules and imperatives.

Book Common Law and Liberal Theory

Download or read book Common Law and Liberal Theory written by James Reist Stoner and published by . This book was released on 1992 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, James Stoner's purpose is to recover the common law basis of American constitutionalism. American constitutionalism in general, he argues, and judicial review in particular, cannot be fully understood without acknowledging their roots in both common law and liberal political theory. But for the most part, the common law underpinnings of constitutionalism have received short shrift.
