Book excerpt: The concept of customary international law, although differently formulated, is already present in early modern European debates on natural law and the law of nations. However, no scholarly monograph has, until now, addressed the relationship between custom and the European natural law and ius gentium tradition. This book tells that neglected story, and offers a solid conceptual framework to contextualize and understand the 'problematic of custom', namely how to identify its normative content. Natural law doctrines, and the different ways in which they help construct human reason, provided custom with such normative content. This normative content consists of a set of fundamental moral values that help identify the status of custom as either a fundamental feature or an original source of ius gentium. This book explores what cultural values and practices facilitated the emergence of custom and rendered it into as a source of the law of nations, and how they did so. Two crucial issues form the core of the book's analysis. Firstly, it qualifies the nature of the interrelation between natural law and ius gentium, explaining why it matters in relation to our understanding of the idea of custom. Second, the book claims that the process of custom formation as a source of law calls into question the role of the authority of history. The interpretation of the past through this approach can thus be described as one of 'invention'.

Book excerpt: The fighting bishop or abbot is a familiar figure to medievalists and much of what is known of the military organization of England in this period is based on ecclesiastical evidence. Unfortunately the fighting cleric has generally been regarded as merely a baron in clerical dress and has consequently fallen into the gap between military and ecclesiastical history. This study addresses three main areas: which clergy engaged in military activity in England, why and when? By what means did they do so? And how did others understand and react to these activities? The book shows that, however vivid such characters as Odo of Bayeux might be in the historical imagination, there was no archetypal militant prelate. There was enormous variation in the character of the clergy that became involved in warfare, their circumstances, the means by which they pursued their military objectives and the way in which they were treated by contemporaries and described by chroniclers. An appreciation of the individual fighting cleric must be both thematically broad and keenly aware of his context. Such individuals cannot therefore be simply slotted into easy categories, even (or perhaps especially) when those categories are informed by contemporary polemic. The implications of this study for our understanding of clerical identity are considerable, as the easy distinction between clerics acting in a secular or ecclesiastical capacity almost entirely breaks down and the legal structures of the period are shown to be almost as equivocal and idiosyncratic as the literary depictions. The implications for military history are equally striking as organisational structures are shown to be more temporary, fluid and 'political' than had previously been understood.

Despite the long-recognized inter-play between these diverse media, historians of the period rarely integrate analysis of sacred music into their research on other modes of worship espoused by relic cults. Holy Treasure and Sacred Song situates this oft-neglected yet critical domain of religious life at the center of an examination of relic cults in medieval Tuscany. Long recognized as a center of artistic innovation during the Renaissance, this region also boasted the rich and well documented veneration of holy bishops and martyrs buried in the cathedrals and suburban shrines of its principal cities. Author Benjamin Brand reveals that the music composed to honor these local saints - no fewer than ninety chants for the Mass and Divine Office - were essential components of larger devotional campaigns that included the recording of their life stories and the building and decoration of their shrines. Furthermore, the local Tuscan clerics who assumed control of these campaigns with the intent of gaining both temporal and spiritual power drew on influential global models - literary, architectural, musical, and ritual - from preeminent European powers, Rome and the Carolingian Empire. By integrating detailed analyses of plainsong and sacred ritual into this rich panorama, Brand traces the dialectic between local, regional, and pan-European trends, revealing the centrality of the liturgy in the development of medieval relic cults and, in a broader sense, medieval European culture and politics. In this unique study, Eternal light and earthly concerns, looks at the material and social consequences of maintaining these ‘eternal’ lights. It investigates how the cost of lighting was met across western Europe throughout the whole of the Middle Ages, revealing the social organisation that was built up around maintaining the lights in the belief that burning them reduced the time spent in Purgatory. When that belief collapsed in the Reformation the eternal lights were summarily extinguished. The history of the lights thus offers not only a new account of change in medieval Europe, but also a sustained examination of the relationship between materiality and belief.
