Book excerpt: The Business Innovation and Skills Committee publishes a report - "The Hargreaves Review of Intellectual Property: where next?" - as part of its inquiry into the Hargreaves Review of Intellectual Property and Growth. The Committee believes further work remains to be done in analysing whether the economic benefits of a parody exception would be as extensive as claimed. However, other grounds may yet support a change to the law by extending what is legally permissible. which would probably help improve public respect for copyright law in general. On content mining, the Committee agrees that the ability to read published scientific data automatically is useful and needs to be opened up. On the the issue of Digital Copyright Exchange, the Committee encourages the Government to push forward with this idea provided that the system is kept simple and there is a proper cost/benefit analysis. On the Government's approach to negotiations on the Unified Patents Court, the Committee is concerned about the Government's approach on this. A unified patent and litigation system could bring many benefits, particularly if the central court were situated in London, but the current proposals have not been welcomed by practitioners or industry.

The Committee also strongly condemns the failure of Google in particular to tackle access of copyright infringing websites through its search engine. Such illegal piracy, combined with proposals arising from the Hargreaves review to introduce copyright exceptions, and a failure to strengthen copyright enforcement as envisaged by the Digital Economy Act 2010, together threaten the livelihoods of the individuals and industries that contribute over £36 billion annually to the UK economy. Also, the Olympics No Marketing Rights scheme is excessively restrictive and is preventing British creative companies from realising the benefits they deserve from the Olympic legacy. The Committee calls for: a central champion of Intellectual Property in Government to promote and protect the interests of UK intellectual property; the maximum penalty for serious online IP theft to be increased to 10 years imprisonment, in line with the punishment for such offences in the physical world; more evidence and scrutiny before any exceptions to copyright such as those suggested by Hargreaves are applied; redoubled efforts to ensure that the video games tax credit is approved by the European Commission and introduced as soon as possible; reforms to the income tax and tax reliefs systems to recognise adequately the freelance nature of much creative work; greater recognition of the importance of arts subjects in the curriculum.

Negotiations between the two are currently underway and the Government hopes that an agreement can be reached by the end of 2015. The trade deal may be beneficial to the UK and EU economies but TTIP is not universally supported and the level of financial benefit to the UK is open to question. The lack of detail available on the negotiations means that it is difficult to assess which is the more accurate argument. However, this should not excuse the quality of debate which we have, on occasion, observed by campaigners and lobbyists on both sides of the argument. Everyone involved in the debate on TTIP - campaigners,lobbyists, the UK Government and the European Commission - must ensure that an evidence-based approach is at the heart of any TTIP debate. One of the key concerns about TTIP is the proposal to include Investor State Dispute Settlement (ISDS) provisions. These provisions - common in bilateral trade agreements - aim to protect foreign investors from illegal interference by the host government. However, campaigners have argued that such clauses could allow US healthcare investors to force the permanent privatisation of the NHS. Although this view has been rebutted repeatedly by the European Commission and the UK Government, until draft clauses are published, it will be difficult for them to convince those with concerns.

Book excerpt: There will always be those who lose out when a company goes into administration and cannot cover all of its debts. However, the current system does not represent the appropriate balance, since those who have given secure credit to a company are cushioned from the full impact of an insolvency, because the losses are borne by those who work for a company on a self-employed basis, or as contractors or suppliers. Under the current rules it is clearly in the financial interest of a company to break the law, and ignore the statutory redundancy consultation period, if the fine for doing so is less than the cost of continuing to trade, especially since this fine will anyway be paid by the taxpayer. However, while the financial calculation is simple, ignoring the consultation period has a high human cost that appears not to have featured in the decision making process at City Link. Employees were denied a reasonable notice period in which to seek alternative employment and instead, at a time of financial uncertainty, have to pursue a court claim for lack of consultation if they wish to be compensated. While there were differences of opinion as to whether or not City Link could be made viable, and the desired level of return could be achieved, the Committees regret that Better Capital felt its investors' interests could only be protected at the expense of the future of City Link and continued employment for its workers

Employing a particular style of letters, choosing which walls and trains to write on, copying another writer, altering or destroying another writer's work: these acts are regulated within the graffiti subculture. Copyright Beyond Law presents findings from empirical research undertaken into the graffiti subculture to show that graffiti writers informally regulate their creativity through a system of norms that are remarkably similar to copyright. The 'graffiti rules' and their copyright law parallels include: the requirement of writing letters (subject matter) and appropriate placement (public policy and morality exceptions for copyright subsistence and the enforcement of copyright), originality and the prohibition of copying (originality and infringement by reproduction), and the prohibition of damage to another writer's works (the moral right of integrity). The intersection between the 'graffiti rules' and copyright law sheds light on the creation of subculture-specific commons and the limits of copyright law in incentivising and regulating the production and location of creativity.
