Book excerpt: This is the seventh report on Ministerial Accountability and Parliamentary Questions and the last that covers the workings of the Code of Practice on Access to Government Information, as in January 2005 this Code was superseded by the Freedom of Information Act. Amongst its conclusions are a concerned that departments have failed to honour fully their undertaking to provide specific Code exemption when they failed to give answers on public interest grounds. The Committee will monitor the effect of the Freedom of Information Act but believes that Cabinet Office guidance is inconsistent with earlier practice and should be reconsidered. The Committee also recommend that there should be an annual report of departmental performance on named-day questions and they strongly deplore and attempt to use the new arrangements of dealing with Questions before Prorogation as a means of avoiding answering a Question.

The stated aim of the document, by the Prime Minister, Gordon Brown, was "a new constitutional settlement that entrusts more power to Parliament and the British people", with two objectives as the bedrock to this approach: (i) to hold power more accountable; (ii) to uphold and enhance the rights and responsibilities of the citizen. The Committee commends the statement and the wide-ranging programme as set out in the Green Paper, and the call for wide consultation and cross-party input. The Committee sees the goals of a new constitutional settlement as ambitious and laudable, but which will require considerable care in establishing a rebalance, in the Committee's view, of the relationship between Government, Parliament and the public.

The Committee's report focuses on the role of traffic law in making our roads and communities safer, and on the role of the police and other agencies in roads policing. Issues discussed include the adequacy of traffic offences and penalties; whether the police and other enforcement agencies have the right priorities; the needs of pedestrians and cyclists; policy options to deal with dangerous drivers before they cause harm; the impact of uninsured, unlicensed and banned drivers on traffic enforcement; and the effects of administrative changes (such as the transfer of network management duties from the police to the Highways Agency) on road safety and effective law enforcement. Findings of the Committee include the need for a radical overhaul of the way serious traffic offences are dealt with, by the police, the Crown Prosecution Service and the courts system, as well as in public attitudes towards poor driving standards. The Committee praises the work undertaken by the Department for Transport to prioritise road safety issues, and calls on the Home Office to act urgently to establish an appropriate legal framework for dealing with road offenders and ensuring our roads are properly policed.

Book excerpt: Demonstrating that the state of civil liberties and human rights in the United Kingdom are quite perilous, this case study looks at the role of rights vis-à-vis social change and culture. Empirically examining the Human Rights Act (HRA), with asylum serving as the main case study, the book focuses on law in action, based on extensive fieldwork and framed against current events. It also discusses the role of Section 55—a law enacted at the same time as the HRA that was an antithesis of what the HRA promised and which forced thousands of asylum-seekers into destitution. Though Section 55 was eventually defeated, asylum-seekers in the UK are still powerless and marginalized. The book argues that the HRA has proven to be ineffective against illiberal policies and that the development of a culture of rights, as far as asylum is concerned, has stalled. This thoughtful analysis of the use of rights laws to advance social causes presents both potential and pitfalls, making it useful for sociologists, activists, and nongovernmental organizations.

The final chapter describes the work undertaken on monitoring action taken by the Government in response to incompatibilities with Convention rights, arising from Strasbourg judgments and declarations of incompatibility by UK courts.

Yet Britain's legislative process is often seen as executive-dominated, and parliament as relatively weak. As this book shows, such impressions can be misleading. Drawing on the largest study of its kind for more than forty years, Meg Russell and Daniel Gover cast new light on the political dynamics that shape the legislative process. They provide a fascinating account of the passage of twelve government bills - collectively attracting more than 4000 proposed amendments - through both the House of Commons and House of Lords. These include highly contested changes such as Labour's identity cards scheme and the coalition's welfare reforms, alongside other relatively uncontroversial measures. As well as studying the parliamentary record and amendments, the study draws from more than 100 interviews with legislative insiders. Following introductory chapters about the Westminster legislative process, the book focuses on the contribution of distinct parliamentary 'actors', including the government, opposition, backbenchers, select committees, and pressure groups. It considers their behaviour in the legislative process, what they seek to achieve, and crucially how they influence policy decisions. The final chapter reflects on Westminster's influence overall, showing this to be far greater than commonly assumed. Book excerpt: The Joint Committee on Human Rights examined the implementation of the UN International Covenant on Economic, Social and Cultural Rights in the UK. Domestic legislation protects many of the economic, social and cultural rights, with the Covenant itself having little impact in UK domestic law. The Committee believes that there is scope for incorporating further protection of rights in the UK, by enshrining some of the guarantees contained in the Covenant. Further, that for the Covenant rights to be effective, they should be part of a framework for government policy development, and that Government along with the Commission for Equality and Human Rights should develop ways of measuring the progress of these rights. The Committee also recommends, that explanatory notes to Bills, should include discussion of the Bills compatibility with Covenant rights, which is a way of enhancing the scrutiny of proposed Government legislation. Furthermore, the Committee recommends the introduction of an Equality Bill, to address the concerns of discrimination faced by ethnic minorities and persons with disabilities in employment, housing and education.

Book excerpt: The Committee's inquiry addresses concerns that the operation of libel laws and the impact of costs were stifling press freedom. It also considers the balance between personal privacy and press freedom, and the increasing use of injunctions and super-injunctions. It also examines press standards in the UK, particularly considering Madeleine McCann's disappearance, the suicides in and around Bridgend in 2008 and phone hacking and blagging. The Committee does not consider that it would be right to legislate on privacy. The Press Complaints Commission (PCC) should amend its Code to include a requirement that journalists notify the subject of their articles prior to publication, subject to a "public interest" test. The report also assesses the damage so called 'libel tourism' has caused to the UK's reputation as a country which protects free speech and freedom of expression. In cases where the UK is not the primary domicile or place of business of the claimant or defendant, the claimant should face additional hurdles before being allowed to bring a case. There is an urgent need to control defamation litigation costs more effectively. Competitive and commercial factors led to an inexcusable lowering of press standards in the gathering and publishing of 'news' about the McCann case, and self-regulation signally failed. The PCC should be renamed the Press Complaints and Standards Commission, reflecting its role as a regulator, not just a complaints handling service. The regulator should have the power to fine its members where it believes that the departure from the Code of Practice is serious enough to warrant a financial penalty.
