The purpose of the Game Laws in Brief is to give the provisions which relate to seasons for fish and game, the limitations as to size or number, transportation, non= resident requirements, and other restrictions, for the practical guidance of sportsmen and anglers as to shooting and fishing. Method. The sections are printed in abstract; but better to insure accuracy, the language is that of the original. Thus, the District of Columbia woodcock law is abstracted as indicated by italics: Woodcock. Sec.3. That no person shall kill or expose for sale, or have in his or her possession, either dead or alive any 7 voodcock, bct7vcen the st day of February and the st day of July under a penalty of five dollars for each bird so killed or in possession. Kill or catch, or other term used, takes the place of the more comprehensive formula of the statute catch, kill, injure or destroy, or pursue with such intent, etc. The laws are general in their application. Numerous local laws obtain in certain of the States. The date of enactment given is of the original statute, but the text is given here as amended to date named on last page facing back cover. If no close season is named for a species the law prescribes none. Penalties, prosecutions, duties of officers, jurisdiction of courts, etc, are omitted as outside the purpose of this work. General Provisions. Possession or sale or transportation is always unlawful in the season when it is unlawful to capture game or fish; except that after the open killing season closes some States allow from three days to one month for the sale of game. Netting game fish or catching or killing them by drugs, explosives, dams, or by any mode other than angling with hook and line, is forbidden. Birds other than game (except of prey) are protected at all times. Netting or snaring game birds, or killing by any mode other than shooting is forbidden. Nests and eggs of all birds (except of prey) are protected. Night shooting is generally prohibited. Wild pigeons are protected in a number of States. For this purpose I would suggest the propriety bf permitting by law, occupiers of land to take and kill game, for sale or Otherwise, on' their own occupations only, unless (if. Tenants) they are specifically prohibited by agreement with their landlord, reserving the game and the power of taking it to himself (as is now frequently done in leases). This permission should not, of course, Operate during the current leases, unless by agreement With this precaution, nothing could be fairer than such an enactment; for it is certainly at the expense of the occupier that the game is raised and maintained: and unless he receive an equivalent for it, either by abatement Of rent upon agreement, or by permission to take and dispose of it, he is' certainly an injured man. Whereas it is perfectly just that the owner of the land should have the Option either to increase his rent by leaving the disposal Of his game to his tenant, or vice vei'sé. Game would be held to be (as in fact it is) an outgoing from the land, like tithe and other burdens, and therefore to be considered inn-d bargain s and land would either be let gumfiee, or a special!
