Available in PDF, EPUB and Kindle. Book excerpt: In The Politics of Islamic Law, Iza Hussin compares India, Malaya, and Egypt during the British colonial period in order to trace the making and transformation of the contemporary category of ‘Islamic law.’ She demonstrates that not only is Islamic law not the shari’ah, its present institutional forms, substantive content, symbolic vocabulary, and relationship to state and society—in short, its politics—are built upon foundations laid during the colonial encounter. Drawing on extensive archival work in English, Arabic, and Malay—from court records to colonial and local papers to private letters and visual material—Hussin offers a view of politics in the colonial period as an iterative series of negotiations between local and colonial powers in multiple locations. She shows how this resulted in a paradox, centralizing Islamic law at the same time that it limited its reach to family and ritual matters, and produced a transformation in the Muslim state, providing the frame within which Islam is articulated today, setting the agenda for ongoing legislation and policy, and defining the limits of change. Combining a genealogy of law with a political analysis of its institutional dynamics, this book offers an up-close look at the ways in which global transformations are realized at the local level.

Book Islam Judaism and Zoroastrianism

Download or read book Islam Judaism and Zoroastrianism written by Zayn R. Kassam and published by Springer. This book was released on 2018-07-16 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers three such religions—Zoraoastrianism, Judaism, and Islam . In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India.

Download or read book Usul al Fiqh written by Recep Dogan and published by Tughra Books. This book was released on 2015-07-07 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the sources of Islamic jurisprudence and their importance in deducing the religious rulings. It covers the concept of ijtihād (independent reasoning), its conditions and application and illustrates why it is a practice for experts rather than laymen. It also explains the differences in the levels of expertise of the mujtahids. In fact, there are seven distinct classifications of mujtahid. The book also covers the communication of God as Lawgiver with regard to the conduct of liable persons. It details the difference in probative value of communication based on the extent to which it binds an individual be it absolutely binding, a recommendation or mere permissibility. The reader will be able to understand the difference between fiqh (law) and Usūl al-Fiqh (methodology of law). Fiqh is the law itself whereas Usūl al-Fiqh is the methodology utilized to extract the law. The relationship between the two disciplines resembles that of the rules of grammar to a language, or of logic to philosophy. Usūl al-Fiqh in this sense provides the standard criteria for the correct deduction of the rulings of fiqh from the sources of Shari’ah (the Qur’an and Sunnah).

Available in PDF, EPUB and Kindle. Book excerpt: Toward an Islamic Reformation is an ambitious attempt to modernize Islamic law, calling for reform of the historical formulations of Islamic law, commonly known as Shari'a that is perceived by many Muslims to be part of the Islamic faith. As a Muslim, Abdullahi Ahmed An-Na'im is sensitive to and appreciative of the delicate relationship between Islam as a religion and Islamic law. Nevertheless, he considers that the questions raised here must be resolved if the public law of Islam is to be implemented today. An-Na'im draws upon the teachings and writings of Sudanese reformer Mahmoud Mohamed Taha to provide what some have called the intellectual foundations for a total reinterpretation of the nature and meaning of Islamic public law.

Book Islam Sharia and Alternative Dispute Resolution

Download or read book Islam Sharia and Alternative Dispute Resolution written by Mohamed M. Keshavjee and published by Bloomsbury Publishing. This book was released on 2013-06-30 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: The meanings and contexts of Shari'a are the subject of both curiosity and misunderstanding by non-Muslims. Shari'a is sometimes crudely characterised by outsiders as a punitive legal system operating broadly outside, and separate from, national laws and customs. This groundbreaking book shows that Shari'a and its 'fiqh' (laws set forward by various Islamic legal schools) comprise a far more nuanced matrix of interpretations than is often assumed to be the case. Far from being monolithic or impervious to change from without, Muslim legal tradition has - since its beginnings in the early Islamic period - placed an emphasis on equity and non-adversarial conflict-resolution. Mohamed Keshavjee examines both Sunni and Shi'a applications of Islamic law, demonstrating how political, cultural and other factors have influenced the practice of fiqh and Shari'a in the West. Exploring in particular the modern development of Alternative Dispute Resolution (ADR), the author shows that this process can revitalise some of the essential principles that underlie Muslim teachings and jurispudence, delivering not only formal remedies but also perceived justice, even to non-Muslims.

Download or read book Fiqh of Social Media written by Omar Usman and published by . This book was released on 2020-12-20 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Social media and digital technologies have changed our lives and there is no indication that things will slow down. As Muslims, we believe that Islam contains the most perfect guidance for all of mankind to follow. How do we implement that timeless advice in our unprecedented times? That is the focus of the Fiqh of Social Media. "I am grateful and appreciative of my friend, Omar Usman, for exhausting available resources; Islamic, psychological, secular, and business, to develop the work you see before you. We have had long discussions pertaining to many of the topics covered in this book. I am confident that you will find this book to be beneficial, and I pray that it inspires more contributions on this topic." -Shaykh AbdulNasir Jangda, Qalam Institute "With the time we spend on social media, being mindful of how we use it is crucial. This is a wonderful resource based in prophetic guidance on how to practically use social media in wise and beneficial ways." -Dr. Omar Suleiman, Yaqeen Institute "Reading Fiqh of Social Media is like sitting with your best friend from Sunday school and having an intellectual & spiritual conversation about the impact of social media on your life. Omar distills years of research, experience, and thought leadership in an easily digestible book that you can enjoy with a good cup of coffee (and your phone off!)" -Mohammed Faris, The Productive Muslim Company "The Prophet (s) said, "Whoever believes in Allah and the Last Day should say something good or keep silent." The ability to control our tongues, how we communicate with others, is an expression of our faith. Communication has evolved and changed so much that one of the primary ways many of us communicate with others is through social media; hashtags and 280 characters. This is a long-awaited work from my good friend and Hajj companion Omar Usman who has been writing, tweeting, speaking, and teaching about the Fiqh of Social Media for years. This is a valuable work providing guidance on how to use and benefit from social media in a way that conforms to our principles and values." -Shaykh Furhan Zubairi, Institute of Knowledge "Ulama of the past have written on the adaab of speech and social interaction. Connecting those guidelines with the modern world of social media has been the need of our time. May Allah reward Omar for taking this task on!" -Mufti Hussain Kamani, Qalam Institute "This is a must-read for Muslims around the globe. I can't thank Omar enough for this work which forces Muslims to look in the mirror and answer tough questions about how social media has impacted our lives. It questions why we desire to share the most intimate aspects of our lives with strangers from around the world and provides action items to implement. These discussions need to be had within the Muslim community. We have to question how our quality of life has been impacted by the age of hyper-connectivity. Due to the fact that Social Media is the tool for creating social capital, we need to realize that speaking about the harms of constant connectivity takes a lot of courage. Thank you, Omar, for this work." -Shaykh Mikaeel Smith, Qalam Institute

Available in PDF, EPUB and Kindle. Book excerpt: The study of Islamic law can be a forbidding prospect for those entering the field for the first time. Wael Hallaq, a leading scholar and practitioner of Islamic law, guides students through the intricacies of the subject in this absorbing introduction. The first half of the book is devoted to a discussion of Islamic law in its pre-modern natural habitat. The second part explains how the law was transformed and ultimately dismantled during the colonial period. In the final chapters, the author charts recent developments and the struggles of the Islamists to negotiate changes which have seen the law emerge as a primarily textual entity focused on fixed punishments and ritual requirements. The book, which includes a chronology, a glossary of key terms, and lists of further reading, will be the first stop for those who wish to understand the fundamentals of Islamic law, its practices and history.
