Book excerpt: Samuel Warren (1807-1877), who also wrote under the pseudonyms Warren Warner, A Late Physician and A Barrister-at-Law, was a novelist, born in Denbighshire, son of a Nonconformist minister. After studying medicine at Edinburgh he took up law, and became a barrister, wrote several legal text-books, and in 1852 was made Recorder of Hull. Warren sat in the House of Commons for Midhurst 1856-1859, and was a Master in Lunacy 1859-77. He was the author of Passages from the Diary of a late Physician, which appeared (1832-37) first in Blackwood's Magazine, as did also Ten Thousand a Year (1839). Both attracted considerable attention, and were often reprinted and translated. His last novel, Now and Then (1847), was a social novel of criminality and the law, arguing from a Methodist perspective the moral case for reform. It is realistically observed, based in outline on an actual case in Wolverhampton, but had little success. Warren entertained exaggerated ideas as to the importance of his place in literature. He also wrote a collection of stories entitled The Experiences of a Barrister, and Confessions of an Attorney (1852/6).

It does so through the experiences and anecdotes of a low-flying criminal barrister. While the cases are from Victoria, the book makes reference to other states and has relevance and interest Australia-wide. The style is light, punchy and informal, with lots of direct speech and many funny yarns. Some of the book is tongue-in-cheek (and even politically incorrect) but it also makes serious points throughout. It's entertaining as well as informative. The chapters are short, and generally deal with specific offences (shop theft, for example) or areas of law (bail). Others recount particular cases in an ironic or colourful way. Most cases are of low to medium criminality so the light-hearted tone is not inappropriate. Most legal memoirs are by big-shot advocates or retired judges. Mostly Guilty is different, and doesn't take itself too seriously.
