It also identifies specific discourses of belonging (gendered, ethnicized/racialized and class-related images of ‘Us’ and ‘Them’) that frame the institutional selectivity by constructing images of mobile EUcitizens' ‘deserving’ or ‘non-deserving’ social membership. The collection offers a detailed examination of inequality experiences mobile EU citizens from the new EU countries encounter while accessing and porting social security rights across borders. Book excerpt: Bulletin of Comparative Labour Relations Volume 108 The progressive expansion of the phenomenon of posting of workers – the practice whereby a worker is sent for a limited period of time to another Member State in order to provide a service – is a formidable bone of contention in the conflict between a fully integrated internal market economy and Member States’ aims to protect domestic social standards. This book challenges the recently adopted Directive (EU) 957/2018, which came into effect in July 2020, by examining the relevant EU regulatory framework and investigating the actual quantitative dimension of the posting phenomenon and its real impact on the EU labour market. In the process, the author exposes a serious misalignment of the legal framework provided for by the new Directive with the EU values and principles of equality, solidarity and fair competition. Drawing on a wide variety of sources – including Court of Justice case law, Advocate Generals’ opinions, Eurostat data, Commission documents and reports, and academic literature – the author provides in-depth analyses of such elements of the problem as the following: proper definition of the concepts of ‘posting’ and ‘posted worker’ in EU law; host country’s discretion in relation to the part of domestic regulation it can impose on posted employees; misconceived clash between social rights and economic freedoms; coordination of national social security systems; proliferation of unlawful and fraudulent practices; ‘regime shopping’ and exploitation of existing regulatory loopholes; misleading association of posting with issues of ‘social dumping’ and ‘unfair competition’; orientation of political influence during the drafting process of relevant EU legislation; expected controversial economic impact of Directive (EU) 957/2018; concrete realisation of the EU values and principles of equality, solidarity and fair competition; and definition and pursuit of a ‘European social model’. Normative arguments developed in the course of the analysis put forward viable recommendations for future improvements in the field. The Union’s commitment to the development of a ‘European social model’ cannot avoid taking into account the matters of equality, solidarity and fair competition. In this sense, given the increasing prominence of the free movement of services in shaping a European labour market characterised by an ever-growing degree of mobility, this book’s analysis of the phenomenon of posting of workers may serve as a litmus test of political and legislative action at EU level. In its dual analytic and normative aspect, the book takes a giant step towards future discussions and developments in the area of intra-EU labour mobility. It will be welcomed by legal practitioners in labour and social security law and industrial relations, legal scholars, EU institutions and agencies, businesses and trade unions.

Today, for example, a highly developed body of law regulates equal treatment in social security and co-ordinates national security schemes; national health services have opened up to patients and service providers from other states; and rules govern the translation of educational and vocational certificates across member states. This state of affairs is all the more remarkable given the relatively limited resources at the EU's disposal and the initial intentions of its founders. During negotiations for the Treaty of Rome in the 1950s, social policy was viewed as the exclusive provenance of the member states. There were to be provisions to facilitate labour mobility within the common market, but until the 1970s social policy making at the EU-level was modest. However, plans for the internal market moved social policy on the EU's decision-making agenda. The Social Chapter was adopted in 1989, and the Single European Act expanded EU competencies in social policy. The Treaties of Maastricht, Amsterdam and Nice all expanded competencies further, so that by the time the heads of government met in Lisbon in 2007 to sign the EU's latest treaty, the extent of supranational control over important aspects of social policy making was quite impressive. This important book provides a full account of the evolution of social policy in the EU and of its current reach. It examines the reasons for the increased role of the EU in the area, in spite of formidable obstacles, and details its effects in member states, where social provision is often the biggest item in government budgets and a crucial issue in national elections. Drawing on research done on welfare states around the world and on European integration, this book provides a distinctive and sophisticated account of social policy in Europe, showing how it must now be understood in the context of multi-level governance in which EU institutions play a pivotal role.

The contrasting trends toward earlier retirement and greater longevity have resulted in steadily increasing retirement costs over the last forty years. One important factor influencing early retirement decisions is the expansion of retirement benefits; but studies predict that most countries, particularly those with early retirement incentives, will be unable to meet future pension and social security obligations. In this timely CESifo volume, Robert Fenge and Pierre Pestieau examine empirical and theoretical evidence that explains why early retirement has become such a burden for social security systems and suggest pension system reforms that will reverse the trend. Drawing on evidence from the European Union (with comparisons to other industrialized countries including the United States and Canada), the authors demonstrate that the effective retirement age is influenced by social security regulations (such as a change in eligibility age) and discuss ways of measuring these embedded incentives. Fenge and Pestieau examine the implicit taxes on prolonged working life from normative and political economy perspectives. They discuss optimal payroll tax rates that minimize distortions of labor supply and retirement decisions and consider alternative ways to finance benefits, including consumption and capital income taxation. They discuss why policies are designed to discourage employment among older workers and why reforms to counter this often meet resistance. They demonstrate, contrary to the belief of many European governments, that pushing older workers into retirement does not free jobs for young unemployed workers. They show that the gap between salaries and productivity is an incentive for employers to rid themselves of older workers and argue that governments should not support this behavior by compensating older workers for the difference between severance payments and salaries in early retirement programs.
