Kimberly K. Smith fills that gap by exploring how liberal political principles apply to animal welfare policy. Focusing on animal welfare in the United States, Governing Animals begins with an account of the historical relationship between animals and the development of the American liberal welfare state. It then turns to the central theoretical argument: Some animals (most prominently pets and livestock) may be considered members of the liberal social contract. That conclusion justifies limited state intervention to defend their welfare - even when such intervention may harm human citizens. Taking the analysis further, the study examines whether citizens may enjoy property rights in animals, what those rights entail, how animals may be represented in our political and legal institutions, and what strategies for reform are most compatible with liberal principles. The book takes up several policy issues along the way, from public funding of animal rescue operations to the ethics of livestock production, animal sacrifice, and animal fighting. Beyond even these specific policy questions, this book asks what sort of liberalism is suitable for the challenges of the twenty-first century. It has been drafted using an extensive comparative law exercise, taking into account 'best practice' in the field. Thus it is aspirational in nature; seeking to provide the best possible structures, systems and provisions to protect the welfare of animals. This may mean that countries which are just starting to establish animal welfare requirements might decide to introduce its provisions progressively. In such cases, a strategic approach (step-wise and prioritised) is recommended. This could also be considered in cases where countries already have structures, systems and provisions that have been introduced gradually over time, but remain less than optimal. The important principle is that each country works progressively towards the best possible protection for the welfare of its animal population, and indeed - as elaborated in the Three Rs approach - the eventual reduction and replacement of any uses of animals which compromise their welfare.The purpose of this Model Animal Welfare Act is to function as an 'umbrella' or 'framework' law. It represents an international unification and harmonisation of animal protection and welfare legislation, which can be adapted or modified - if the circumstances require - in Common Law as well as Civil Law systems. Elements of both legal orders have been considered and incorporated to achieve (as far as possible for the present day) a comprehensive, far-reaching and progressive approach to animal welfare legislation which takes account of the desired expedience when it comes to prevention of animal cruelty and abuse, establishing responsibility and the principle of care towards the animal, promoting the education and sensitisation of the population, as well as offering effective solutions for efficient law enforcement. This Model Act was created in order to govern people's behaviour, while other civil or religious legal systems may take a very different form (for example, be limited to 'codes' or 'edicts'). Nonetheless, elements of this Act can also be used for inspiration in creating, amending or interpreting these.

Book excerpt: Members of the “animal welfare science community”, which includes both scientists and philosophers, have illegitimately appropriated the concept of animal welfare by claiming to have given a scientific account of it that is more objectively valid than the more “sentimental” account given by animal liberationists. This strategy has been used to argue for merely limited reform in the use of animals. This strategy was initially employed as a way of “sympathetically” responding to the abolitionist claims of anti-vivisectionists, who objected to the use of animals in research. It was subsequently used by farm animal scientists. The primarily reformist (as opposed to abolitionist) goals of this community make the false assumption that there are conditions under which animals may be raised and slaughtered for food or used as models in scientific research that are ethically acceptable. The tendency of the animal welfare science community is to accept this assumption as their framework of inquiry, and thus to discount certain practices as harmful to the interests of the animals that they affect. For example, animal welfare is conceptualized is such a way that death does not count as harmful to the interests of animal, nor prolonged life a benefit.
