These laws and regulations impose serious restrictions on the movements of convicted sex offenders. This is controversial because these laws and regulations occur after the sex offender has completed his time in prison. These laws and regulations are intended to have both a deterrent and therapeutic effect. Residency restrictions seek to prevent sex offenders from recommitting their crimes and civil commitment provides psychological services while incarcerated in a forensic facility. Most works on this subject are deeply critical of these laws. Cary Federman takes a more sympathetic approach to sex offender legislation. He focuses on the deliberative intentions of legislators, exploring the limits of judicial review and the rights of interested parties to influence lawmaking. Leaders of these interested parties are usually the parents of children who have been sexually violated and murdered. Critics of sex offender legislation tend to focus on the convicted parties, arguing that their rights have been violated. Democracy and Deliberation asserts that these laws are expressions of the deliberative intentions of lawmakers concerned about public safety—they are thus constitutional, if not always wise.

Book excerpt: The use of residency restriction laws to monitor and control the movements of registered sex offenders in the United States has gained momentum in recent years since the passage of the first federal laws mandating sex offender registries. More than 30 states and hundreds of cities and towns have passed these laws. The purported theory behind residency restriction laws is to prevent registered sex offenders from possible interactions with potential victims. While the residency restriction laws may be theoretically sound, in practice there has been little in the way of empirical proof that they work as designed. As of yet, Massachusetts does not have a statewide residency restriction law, however, there is continuing pressure to enact one. This study explored the possible effects of such a law on those who would be most affected by it: registered sex offenders in Massachusetts. The theoretical framework drew upon social exclusion, disintegration, and labeling theories regarding the potential effects of residency restriction. One hundred registered sex offenders were selected to take part in a survey responding to 12 statements designed to determine their perceptions and attitudes towards potential residency restriction laws. The survey was followed by open-ended interviews with ten of the participating registered sex offenders. The results of the survey and the interviews show that the vast majority of the participants felt that the residency restriction laws would hinder their ability to reintegrate into society. Such findings consequently suggest that new laws would not provide additional safety to potential victims and might instead lead to increased recidivism (repeat offending).

In the USA the former Attorney General Janet Reno identified the issue as 'one of the most pressing problems we face as a nation' in view of the massive prison population and the rapid increase in rates of incarceration, while in the UK it has become an increasingly important issue for similar reasons, and the subject of recent reports by HM Inspectorate of Prisons and HM Inspectorate of Probation, as well as from the Social Exclusion Unit of the Home Office. Yet this issue has not been well served by the criminological literature, and the new policies and programmes that have been set up to address the problem have not been well grounded in criminological thinking. This book seeks to address the important set of issues involved by bringing together the best of recent thinking and research into desistance from crime, drawing upon research in both the UK and the USA, and with a distinct focus on how this might impact upon the design and implementation of ex-offender reintegration policy.

Largely uneducated, unskilled, often without family support, and with the stigma of a prison record hanging over them, many if not most will experience serious social and psychological problems after release. Fewer than one in three prisoners receive substance abuse or mental health treatment while incarcerated, and each year fewer and fewer participate in the dwindling number of vocational or educational pre-release programs, leaving many all but unemployable. Not surprisingly, the great majority is rearrested, most within six months of their release. What happens when all those sent down the river come back up--and out? As long as there have been prisons, society has struggled with how best to help prisoners reintegrate once released. But the current situation is unprecedented. As a result of the quadrupling of the American prison population in the last quarter century, the number of returning offenders dwarfs anything in America's history. Book excerpt: There is a meager amount of literature available on how criminal justice system actors perceive the range of sex offender registration and community notification (SORN) policies and their effectiveness, as well as sex offenders themselves. To date, only one study has been done on judges regarding their attitudes toward sexual offenders by Bumby and Maddox (1999). However, a study has not been completed in regard to judges' perceptions of SORN and its efficacy in addition to their views on residency restrictions. The following study tries to expand the literature available and examines the perceptions of judges concerning SORN, residency restrictions, and sexual offenders. A survey was distributed which contained the Community Attitudes Toward Sex Offenders (CATSO) scale (Church, et al. 2008). This scale was recommended to be used with actors of the criminal justice system; however, this study examines if the scale is an efficient instrument for categorizing the perceptions of judges. The findings are discussed.

Yet politicians and the media overemphasize predatory strangers when legislating against and reporting on sexual violence. In this book, Eric S. He shows that "sexual predator" laws, which have intense public and political support, are counterproductive.Janus contends that aggressive measures such as civil commitment and Megan's law, which are designed to restrain sex offenders before they can commit another crime, are bad policy and do little to actually reduce sexual violence.
