Book excerpt: Excerpt from The Early History of English Poor Relief The present account of the early history of English poor relief is chiefly derived from the municipal records of London and Norwich and from the reports of the justices of the peace which are included amongst the state papers. Information on the subject is also contained in the Privy Council Register, while some of the orders of both Privy Council and justices and a few of the overseers' accounts are to be found in the collections of the British Museum. A fairly effectual system of relieving the destitute by public authority has had in England a continuous existence since the seventeenth century. Attempts to found such a system of poor relief in the sixteenth century were common to most of the countries of Western Europe, but the continued existence of any organisation of the kind is peculiar to England. Possibly this fact has an important influence on our national history. We are apt to consider the facts that we are a law-abiding people and that we have not suffered from violent revolutions to be entirely due to the virtues of the national character and the excellence of the British Constitution. But before the introduction of our system of relieving the poor we were by no means so free from disorder. The poor laws themselves were at least partly police measures, and, until they were successfully administered, the country was repeatedly disturbed by rebellions and constantly plagued by vagrants. Modern child support law must also be considered in the context of both social and demographic changes and in the light of popular norms about child maintenance liabilities. The main part of the book is devoted to an analysis of the modern child support scheme, and the key issues are addressed: the distinction between applications in 'private' and 'benefit' cases and the extent to which the courts retain a role in child maintenance matters; the basis for, and the justification for, the exception from the obligation for parents with care on benefit to co-operate with the Child Support Agency where they fear 'undue harm or distress'; the assessment of income for the purposes of the formula and the evidential difficulties this entails; the tension between the formula, which ignores the parent with care's income, and the demands of distributive justice; the further conflict between the formula, under which liability is capped only for the very wealthy, and the traditional approach of private law, which is premised on children being entitled to maintenance rather than a share in family wealth; the treatment of special cases under the formula by way of 'variations' (formerly 'departures'); the nature of decision-making and the scope for appeals; and the efficacy of the provisions relating to collection and enforcement. This book has been shortlisted for the 2007 SLSA Book Prize.

Juan-Luis Vives's De Subventione Pauperum (On the Relief of the Poor) is an academic report on the organisation of social welfare, prepared for the senate of Bruges and published in 1526. Forma Subventionis Pauperum (The government of poor relief), published in 1531, is an anonymous evaluation report. It reviews the system of poor relief in the city of Ypres, five years after the policy was introduced. These reports lay out methods and approaches for the delivery of social services within their cities. Unemployed people should be found work or helped to start a business. People with disabilities or mental illness should be treated seriously and recognised for what they can do. Migrants should be helped, even if it is not possible to assist everyone. Special efforts should be made to help people who are reluctant or too proud to claim. Services have to be properly organised, records have to be kept and the use of funds has to be publicly accountable and subject to audit. The sophistication of the arguments developed in these studies will surprise many readers. They deserve to be read by everyone with an interest in social policy or public administration.
