That our ancestors should have expressed such profound admiration for the common law while deviating so widely from it in practice, must have puzzled many who have not learned to put a true value upon the flights of forensic oratory. History alone supplies the key, and colonial legal history has not received the attention it deserves. The absence of reports, the destruction of many records and the inaccessibility of those that have been preserved, have all contributed to discourage work in a field usually abandoned to the antiquarian. But as American law increases in importance, the story of its obscure beginnings will require careful consideration. The history of the colony of Pennsylvania is especially interesting, as it takes its beginning with the political and legal ideas of Penn. The author has studied the development of the entire system of courts in Pennsylvania down to the beginning of the nineteenth century. The work is founded upon direct research in all the available sources. The value of this book is enhanced by the manner of treatment; the author does not confine himself to a study of the organization of courts, but in dealing with their jurisdiction and methods, he presents an abundance of interesting material which throws light upon the general development of law in the colonial era and the early decades of the Commonwealth. A Repub lican in politics, he was elected to the State Legislature in 1877, 1878, and 1879, then continued in successful practice until 1896, when he was elected judge of the Court of Common Pleas N O. 2, of Allegheny county, being reelected in 1906. He was made President Judge of the Court Of Com mon Pleas no. 2, of Allegheny county, November 5, 1900, and later, upon the consolidation of the Common Pleas courts, he became President Judge of the reorganized Common Pleas Court, serving until January, 1915. In November, 1914, Judge Frazer was elected a justice of the Supreme Court of Pennsylvania for the term of 1914-1936. Justice Frazer is a United Presbyterian. My years of study of Lloyd was paralleled by a like study of a figure of even greater power as a constitution-maker, namely, James Wilson. A Life of Wilson was so con siderable a project that I had placed it some time in the future. The appreciation which I found here and there for this pre-eminent statesman, however, in my efforts to have the state and nation join in honoring his memory in the removal of his remains to Christ Church, Philadel phia, was so genuine, so widespread and so abundant that I have yielded to the urgency of my friend, Dr. S. Weir Mitchell, and others, and arranged to undertake a full and authoritative Life and Works of James Wilson during the present year. In New York, he said, these complaints were not heard. The people there were not only satisfied with their courts of justice, but seemed to take a pride in them. It must be Something unusual that would delay the decision of a suit, in that state, longer than a twelvemonth; and, alarge majority of the causes was disposed of in nine, and many of them in six, months after they were brought. And yet, he said, the sys tems of law in the two states were the same, or did not materially differ. Each, state had, in an equal degree, its republican institutions and manners. Each has also had an equallyrepublican administration of its government. New York boasts her attachment to the freest systems in politics and jurisprudence, Her Clintons, her Livingstons, her Spencers have been her public servants. These are the men in whose hands her interests have prospered. How then does It happen that, in two contigu ous states, possessing the same kind of gov ernment and giving their confidence to the same kind of men, there should be, in a mat ter so essential, this striking difference; that in the one, the laws should be so administered as to yield benefits to all, while, in the other, their tardy or oppressive execution are the subject of universal complaint.
