Book The Distruptive Lawyer s Little Black Book of Litigation Management

Download or read book The Distruptive Lawyer s Little Black Book of Litigation Management written by William T. Mitchell and published by . This book was released on 2016-04-13 with total page 149 pages. Available in PDF, EPUB and Kindle. Book excerpt: It all started in 1996 when a client took a chance and called Bill with a simple message: "Here's your opportunity. Our regular lawyer has a conflict. Before the conflict, that lawyer said this case was a winner on a motion for summary judgment (MSJ) and provided a $70,000 fee budget. If you can get rid of it efficiently, I will send you more cases."With this incentive, Bill assessed the new case and agreed it was an MSJ case. But, rather than serving discovery and taking depositions, he went a different direction. He set out to convince the plaintiff's counsel to dismiss the case against his client due to its lack of merit and instead direct his attention to the other case defendants. It worked, and Bill secured a voluntary dismissal from the plaintiff's counsel without any discovery. The fee was less than $5,000, and the case was closed within six weeks of the assignment. While some might say the law firm "lost $65,000" by not litigating the case, they would be dead wrong. This result and the process that produced it led to hundreds of cases and were instrumental in growing the firm from four lawyers in Georgia to over fifty attorneys across several states. The goal remains to be the Disruptive Lawyer who consistently produces excellent results as defined by clients' specific performance goals.

Book Supervision in the Legal Profession

Download or read book Supervision in the Legal Profession written by Michael John McNamara and published by Springer Nature. This book was released on 2020-04-30 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about supervision in the legal profession with a focus on the experience of novice lawyers. It is the first of its kind. Until now there have been a range of books dedicated to professional supervision in many disciplines, but not law. Supervision is an important link between formal university-based legal education and independent practice and is relevant to a range of contemporary legal practice issues including changes driven by technology, workplace culture, regulating law firm management, and well-being. This book aims to be scholarly and practical. It provides an overview of how supervision is positioned in the legal regulatory framework; it describes how supervision is conceived in the legal profession and practice management literature; and draws lessons from clinical legal education and other professional disciplines. By reporting on survey data, this book also provides insights into practitioners’ attitudes and perceptions about supervision in legal practice.

Book Getting to Maybe

  • Author : Richard Michael Fischl
  • Publisher : Carolina Academic Press
  • Release : 1999-05-01
  • ISBN : 161163217X

Download or read book Getting to Maybe written by Richard Michael Fischl and published by Carolina Academic Press. This book was released on 1999-05-01 with total page 383 pages. Available in PDF, EPUB and Kindle. Book excerpt: Professors Fischl and Paul explain law school exams in ways no one has before, all with an eye toward improving the reader’s performance. The book begins by describing the difference between educational cultures that praise students for “right answers,” and the law school culture that rewards nuanced analysis of ambiguous situations in which more than one approach may be correct. Enormous care is devoted to explaining precisely how and why legal analysis frequently produces such perplexing situations. But the authors don’t stop with mere description. Instead, Getting to Maybe teaches how to excel on law school exams by showing the reader how legal analysis can be brought to bear on examination problems. The book contains hints on studying and preparation that go well beyond conventional advice. The authors also illustrate how to argue both sides of a legal issue without appearing wishy-washy or indecisive. Above all, the book explains why exam questions may generate feelings of uncertainty or doubt about correct legal outcomes and how the student can turn these feelings to his or her advantage. In sum, although the authors believe that no exam guide can substitute for a firm grasp of substantive material, readers who devote the necessary time to learning the law will find this book an invaluable guide to translating learning into better exam performance. “This book should revolutionize the ordeal of studying for law school exams… Its clear, insightful, fun to read, and right on the money.” — Duncan Kennedy, Carter Professor of General Jurisprudence, Harvard Law School “Finally a study aid that takes legal theory seriously… Students who master these lessons will surely write better exams. More importantly, they will also learn to be better lawyers.” — Steven L. Winter, Brooklyn Law School “If you can't spot a 'fork in the law' or a 'fork in the facts' in an exam hypothetical, get this book. If you don’t know how to play 'Czar of the Universe' on law school exams (or why), get this book. And if you do want to learn how to think like a lawyer—a good one—get this book. It's, quite simply, stone cold brilliant.” — Pierre Schlag, University of Colorado School of Law (Law Preview Book Review on The Princeton Review website) Attend a Getting to Maybe seminar! But why? Because currently, there are five generations in the workplace: Radio Babies (born during 1930-1945); Baby Boomers (1946-1964); Generation X (1965-1976); Generation Y (1977-1991); even some Millennials (1991 and later). Each of them has a different perspective, based on their upbringing and daily lives. The key to making encounters between the generations successful is learning to understand the point of view of each generation and respect their differences. The individuals and organizations that do this will be the ones to succeed. This book will show you how. Authors Gravett and Throckmorton take a dynamic approach to the situation by writing in two distinct voices—as a Baby Boomer and a Gen-Xer—using a "point-counterpoint" approach to identify differences and similarities across generations. They share hands-on experiences, real-life cases, recommended solutions, and ground-breaking research on how members of any generation can better relate to minimize conflict, miscommunication, and wasted energy. You will learn what each generation thinks of the others and how each wishes the others viewed it. Book Game Theory and the Humanities

Download or read book Game Theory and the Humanities written by Steven J. Brams and published by MIT Press. This book was released on 2011 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: Game theory models are ubiquitous in economics, common in political science, and increasingly used in psychology and sociology; in evolutionary biology, they offer compelling explanations for competition in nature. But game theory has been only sporadically applied to the humanities; indeed, we almost never associate mathematical calculations of strategic choice with the worlds of literature, history, and philosophy. And yet, as Steven Brams shows, game theory can illuminate the rational choices made by characters in texts ranging from the Bible to Joseph Heller's Catch-22 and can explicate strategic questions in law, history, and philosophy. - Brams's strategic exegesis of texts helps the reader relate characters' goals to their choices and the consequences of those choices. Much of his analysis is based on the theory of moves (TOM), which is grounded in game theory, and which he develops gradually and applies systematically throughout. TOM illuminates the dynamics of player choices, including their misperceptions, deceptions, and uses of different kinds of power.

Download or read book Mathematics and Democracy written by Steven J. Brams and published by Princeton University Press. This book was released on 2009-12-02 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: Voters today often desert a preferred candidate for a more viable second choice to avoid wasting their vote. Likewise, parties to a dispute often find themselves unable to agree on a fair division of contested goods. In Mathematics and Democracy, Steven Brams, a leading authority in the use of mathematics to design decision-making processes, shows how social-choice and game theory could make political and social institutions more democratic. Using mathematical analysis, he develops rigorous new procedures that enable voters to better express themselves and that allow disputants to divide goods more fairly. One of the procedures that Brams proposes is "approval voting," which allows voters to vote for as many candidates as they like or consider acceptable. There is no ranking, and the candidate with the most votes wins. The voter no longer has to consider whether a vote for a preferred but less popular candidate might be wasted. In the same vein, Brams puts forward new, more equitable procedures for resolving disputes over divisible and indivisible goods.
