Through the Common Agricultural Policy, Common Fisheries Policy, the Birds and Habitats Directives, the Water Framework Directive and a myriad of other legislations and institutions, the EU has had a deciding role in how the UK’s rural environment is governed. Disentangling this policy legacy is a complex process and offers both opportunities and challenges for policy makers, institutions, organisations and stakeholders across the UK as they strive to create appropriate new governance structures. With the Agriculture Bill, the 25-Year Environment Plan and the founding of the Office of Environmental Protection, the UK government has provided at least a degree of clarity on the future direction of environmental governance, but much remains uncertain, not least how this is engaged with by different stakeholders. While Brexit is the lens through which rural policy and sustainability are interrogated, this collection demonstrates the underpinning features of rural policy and society, identifying opportunities for addressing deep-seated policy weaknesses thereby creating a more sustainable and equitable rural society. This book brings together academics, established and early career, to discuss the impact of Brexit on rural environmental governance and on the wider sustainability of rural society, relating to three overall themes: rural governance, sustainable land use, and sustainable rural communities. In doing so, it considers sectors beyond agriculture, paying attention to social relations, community infrastructure, the environment, rural development and broader issues of land use. Book excerpt: After five years of debates, consultations and negotiations, the European institutions reached an agreement in 2013 on the Common Agricultural Policy (CAP) for the 2014-2020 period. The outcome has major implications for the EU’s budget and farmers’ incomes, but also for Europe’s environment, its contribution to global climate change and to food security in the EU and in the world. It was decided to spend more than €400 billion during the rest of the decade on the CAP. The official claims are that the new CAP will take better account of society's expectations and lead to far-reaching changes by making subsidies fairer and ‘greener’ and making the CAP more efficient. It is also asserted that the CAP will play a key part in achieving the overall objective of promoting smart, sustainable and inclusive growth. However, there is significant scepticism about these claims and disappointment with the outcome of the decision-making, the first in which the European Parliament was involved under the co-decision procedure. In contrast to earlier reforms where more substantive changes were made to the CAP, the factors that induced the policy discussions in 2008-13 and those that influenced the decision-making did not reinforce each other. On the contrary, they sometimes counteracted one another, yielding an ‘imperfect storm’ as it were, resulting in more status quo and fewer changes. This book discusses the outcome of the decision-making and the factors that influenced the policy choices and decisions. The recommendations to introduce such a scheme would create a new legal tool, enabling landowners to protect land in order to conserve and restore our natural and built environment. Conservation covenants would allow landowners voluntarily to create binding obligations on their own land to meet a conservation objective, such as preserving woodland, cultivating a particular species of plant or protecting a habitat for an animal, or farming land in a certain way. The proposed statutory scheme would give individual landowners the opportunity, using private agreements, to contribute to conservation efforts being made across England and Wales. The scheme will create a versatile, simple and cost-effective legal tool capable of: unlocking currently missed conservation opportunities by overcoming the legal difficulties faced when creating binding obligations; facilitating better ways to deliver existing conservation objectives; and providing assurance of long-term conservation benefits. The report includes a draft Conservation Covenants Bill, which would introduce the conservation covenant scheme into the law of England and Wales.
