There are sound reasons for being cau tious about the recall of a good judge who has rendered an unwise and improper decision. Every public servant, no matter how valuable, and not omitting Washington or Lincoln or Marshall at times makes mistakes. Therefore we should be cautious about recalling the judge, and we should be cautious about interfering in any way with the judge in decisions which he makes in the ordi nary course as between individuals. But when a judge decides a constitutional question, when he decides what the people as a whole can or can not do, the people should have the right to recall that decision if they think it wrong. There is no exact point at which a community ceases to be aristocratic and becomes democratic, and it is quite obvious that a community may be aristocratic as respects a second and at the same time democratic in relation to a third. France under the Orleans monarchy vested supreme political power in some voters, while under the second empire there were More than one of the states of our Union at the outset had suffrage laws so restrictive in character that they were decidedly aristocratic as compared with their present status, although undoubtedly democratic in comparison even with France under Louis Philippe. An organized political community, independent of external control, is commonly called a state. There is, however, often a confusion of thought arising from the more or less unconscious use of the term state in two different senses. These two applications of the term should be sharply distinguished, and the distinction kept always in mind. In the larger sense the state includes the whole community living in a given terri tory and subject to the political authority of its government. In the limited sense the state includes only that portion of the community which has political authority over the whole, and whose agent in the exercise of that authority is the government. The state in the larger sense we may, for convenience, call the social state. The other may be called the political state. The members of the social state are all subject to law. The political state creates law and enforces it. Political power belongs to the political state, to be sure, for the protection and welfare of the social state. Book excerpt: Excerpt from Essays on the Constitution of the United States: Published During Its Discussion by the People, 1787-1788 In 1888 the editor selected from the pamphlet arguments published during the discussion of the Constitution of the United States, prior to its ratification by the States, a collection of fourteen tracts, and printed them in a volume under the title of Pamphlets on the Constitution of the United States. The reception given that collection clearly proved that these writings were only neglected because of their rarity and inaccessibility, and has induced the editor to collect another, though largely similar class of writings, which he believes of equal value and equally unknown. In the great discussion which took place in the years 1787 and 1788 of the adoption or rejection of the Constitution of the United States, one of the important methods of influencing public opinion, resorted to by the partisans and enemies of the proposed frame of government, was the contribution of essays to the press of the period. The newspapers were filled with anonymous articles on this question, usually the product of the great statesmen and writers of that period. Often of marked ability, and valuable as the personal views of the writers, the dispersion and destruction of the papers that contained them have resulted in their almost entire neglect as historical or legal writings, and the difficulty of their proper use has been further increased by their anonymous character, which largely destroyed the authority and weight they would have carried, had their true writers been known. Rather than a struggle between liberalism and republicanism, we should speak about liberal republicanism. Rather than republicanism versus liberalism, we should address liberalism versus illiberalism, the true issue of our age.

They are interesting as representing a geological survival, but they are dangerous whenever there is the least chance of their making the principles of this ages-buried past living factors in our presentlife. They are not in sympathy with men of good minds and sound civic morality. Furthermore, the Chicago convention attacked the Supreme Court. Again, this represents a species of atavism - that is, of recurrence to the ways of thought of remote barbarian ancestors. Savages do not like an independent and upright judiciary. They want. The judge to decide their way, and if he does not they want to behead him. The Populist-s experience much the same emotions when they realize that the judi ciary stands between them and plunder. Let us now examine what Lincoln said or wrote and try to deter mine whether he stood for the new or the old, for self-limited or for direct and unlimited democracy with especial reference to the two points of government by representation and judicial independ ence. On one most memorable occasion Lincoln told the world what the Government was for which the people whom he led were pouring out their treasure and offering up their lives.
