Book Constitutional Principles of Local Self Government in Europe

Download or read book Constitutional Principles of Local Self Government in Europe written by Giovanni Boggero and published by BRILL. This book was released on 2017-09-25 with total page 350 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Constitutional Principles of Local Self-Government in Europe Giovanni Boggero offers a meticulous account of the defining features of European constitutional local government law using both an international and comparative law perspective. The book argues that differences between local government systems in Europe, typical examples of internal affairs of a State, can be smoothed away by construing a consistent system of constitutional principles to be coherently applied at domestic level across the whole European legal space. This system can be best grasped by looking at the European Charter of Local Self-Government, which embodies a concept of self-government rooted in common legal traditions, and at its subsequent practice within the Council of Europe.

Book Local Self Government and the Right to the City

Download or read book Local Self Government and the Right to the City written by Warren Magnusson and published by McGill-Queen's Press - MQUP. This book was released on 2015-06-01 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite decades of talk about globalization, democracy still depends on local self-government. In Local Self-Government and the Right to the City, Warren Magnusson argues that it is the principle behind claims to personal autonomy, community control, and national self-determination, and holds the promise of more peaceful politics. Unfortunately, state-centred thinking has obscured understanding of what local self-government can mean and hindered efforts to make good on what activists have called the "right to the city." In this collection of essays, Magnusson reflects on his own efforts to make sense of what local self-government can actually mean, using the old ideal of the town meeting as a touchstone. Why cannot communities govern themselves? Why fear direct democracy? As he suggests, putting more trust in the proliferating practices of government and self-government will actually make cities work better, and enable us to see how to localize democracy appropriately. He shows that doing so will require citizens and governments to come to terms with the multiplicity, indeterminacy, and uncertainty implicit in politics and steer clear of sovereign solutions. The culmination of a life’s work by Canada’s leading political theorist in the field, Local Self-Government and the Right to the City ranges across topics such as local government, social movements, constitutional law, urban political economy, and democratic theory.

Book Local Self Governments and Human Rights in India

Download or read book Local Self Governments and Human Rights in India written by Putta V. V. Satyanarayana and published by . This book was released on 2019-04-19 with total page 24 pages. Available in PDF, EPUB and Kindle. Book excerpt: Academic Paper from the year 2018 in the subject Politics - International Politics - Region: South Asia, grade: 2.8, language: English, abstract: This paper argues that as isolation of villages is forever broken by inroads of media, technology and spatial mobility, the existing local government system will only help weave the village into the broader social fabric. This paper consists of three parts. Part one traces the origin and development of local self-governments in India and the significance of 73rd and 74th constitutional amendment acts. Part two consists of the features of local self-governments in India and the issues involved in it such as caste, economic factors and gender disparity. Part three analysis the interface of human rights and local self-governments and it is followed by a conclusion. The system of local self-government has taken a leap forward in guaranteeing a life of dignity and respect to the citizen at the local village level in India. In a formal sense, all the states in India have conformed to the constitutional requirement of ensuring the participation in the local self-governments to the hitherto excluded groups through the system of reservation. This institutionalisation of local self-governments since 1990s that has added greater momentum to the decentralisation process has also had some deeper implications for the human rights situation in India. Even as the democratic process has been extended, changes in traditional society have involved conflict. Therefore on the other side after India had taken bold steps to strengthen decentralisation and local self-governance system the human rights violations at all levels have not decreased. It is ironical that elections in India become an occasion for serious human rights violations. Although it happens even during elections to the states and parliament the violence is more in the local elections as the polling percentage is higher at this level. Further, violence has increased at t

Download or read book Militant Democracy written by András Sajó and published by Eleven International Publishing. This book was released on 2004 with total page 271 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of contributions by leading scholars on theoretical and contemporary problems of militant democracy. The term 'militant democracy' was first coined in 1937. In a militant democracy preventive measures are aimed, at least in practice, at restricting people who would openly contest and challenge democratic institutions and fundamental preconditions of democracy like secularism - even though such persons act within the existing limits of, and rely on the rights offered by, democracy. In the shadow of the current wars on terrorism, which can also involve rights restrictions, the overlapping though distinct problem of militant democracy seems to be lost, notwithstanding its importance for emerging and established democracies. This volume will be of particular significance outside the German-speaking world, since the bulk of the relevant literature on militant democracy is in the German language. The book is of interest to academics in the field of law, political studies and constitutionalism.
