Book excerpt: Under current proposals the Maritime & Coastguard Agency plans to close ten of the existing 14 Maritime Rescue Coordination Centres and to leave three that remain open on a 24-hour basis and five that will operate in "daylight" hours only. The Transport Committee found little support for the measures and has no confidence that, under these proposals, the Coastguard will in future be able to respond to emergencies at sea as well as they do now, let alone in a more effective way. The Committee is not convinced by the Government's claim that technology can, at present, replace local knowledge. Serious concerns were raised that the safety of people at sea, on cliffs and beaches will be jeopardised if the proposals proceed in their current form. Ministers must issue revised proposals for further consultation. The Committee also strongly condemns the Government's cost-cutting decision to withdraw funding for the four Emergency Towing Vessels (ETVs) stationed around the UK coast - large tugs that intercept disabled ships to prevent environmental pollution disasters. The Transport Committee also criticises proposals to completely remove government funding for the Maritime Incident Response group (MIRG), a national fire-fighting-at-sea capability. Ministers should instead adopt a slimmed-down MIRG which is more cost-effective than the present arrangement. Lastly, the Committee records its disappointment that Mike Penning MP, Minister for Shipping, instructed regular coastguards not to give oral evidence to the committee on the basis that they were junior civil servants.

Book excerpt: This report reviews the Government's plans to tackle fraudulent and exaggerated motor insurance claims, particularly for whiplash injuries. It is the Transport Committee's fourth report on the cost of motor insurance and, while premiums are now falling, aspects of the market remain dysfunctional and have encouraged criminality to take root. Further action is still required to tackle fraud whilst protecting genuine claimants. The Government must prohibit insurers from settling whiplash claims before the claimant has undergone a medical examination. On issues of court procedure and medical panels the Committee endorses the Government's intention to require courts to strike out 'dishonest' insurance claims (e.g. those involving gross exaggeration), but cautions against hasty legislation due to the complex legal implications. The report calls for data sharing about potentially fraudulent claims between insurers and claimant solicitors to be made compulsory rather than voluntary (as currently proposed). The Government should oversee funding arrangements for the police Insurance Fraud Enforcement Department, to make sure that this unit, currently funded directly by the insurance industry, has a long-term future. Government proposals for independent medical assessments are welcomed but more work is required on implementation. The Government should press the Solicitors Regulation Authority to stop some solicitors from playing the system to maximise their income by commissioning unnecessary psychological evaluations.

Book excerpt: Flight time limitations regulate the number of hours that pilots and crew work in order to prevent fatigue. Fatigue contributes 15-20% of fatal aviation incidents caused by human error. In July 2013, Member States of the European Union voted strongly in support of a draft proposal on flight time limitations by the European Commission. Overall, the Commission's draft regulation represents an improvement but concerns remain. Particularly about the apparent reluctance of the Commission when developing these regulations to set a lower limit for the flight duty period at night in accordance with the scientific evidence on this matter. It is disappointing that the UK Government has not pressed for a lower limit. It is also disappointing that a consensus has not been reached on the draft regulations with crew and pilot representatives. It is recommended that the European Scrutiny Committee requests the UK Government to press the Commission to ensure an effective monitoring regime is put in place to examine whether the 11 hour limit is at least as safe as the current regime and that they request the European Commission provide an assessment of the regulation two years after its implementation. The Committee also concluded that: the potential under-reporting of pilot fatigue must be properly recognised if it is to be effectively tackled; information should be regularly published on the use of Commander's discretion to extend their crew's flight duty period if unforeseen circumstances arise; and scientists must have a more central role in the development and assessment of flight time limitation proposals

Book excerpt: The National Policy Statement on National Networks, published in draft for consultation (ISBN 9780108560071), sets out the policy against which decisions will be made on applications for development consent for nationally significant infrastructure projects on the strategic road and rail networks. The Committee has a number of detailed recommendations to improve the draft. The NPS should specify more types of transport scheme which the Government thinks are needed, such as enhancements to the rail network to promote east-west connectivity; better road and rail connections to ports and airports and to parts of the country which are currently not well served by those networks; and schemes to promote regional economic development. Criticisms of the DfT's road and rail demand forecasts should be addressed. Estimates of the impact on UK carbon emissions of building more road infrastructure are needed. Adverse impacts of major transport schemes on localities should be set out. The NPS should make explicit reference to the desirability of connecting HS2 to the classic rail network. Promoters of roads schemes must look to improve road safety (including for cyclists and pedestrians). The Government is seeking to accommodate increasing demand for roads by building more infrastructure rather than seeking to manage demand. Investment in the road network will require new funding streams, a challenge that must be addressed. However, a consensus would be required to introduce any road user charging scheme across the strategic road network as an alternative to road taxation.

Book excerpt: Transport infrastructure in some parts of the UK may get left behind under the new system to be used from next year (2015) to share out central government money for local major transport schemes. The Government has again changed the system for distributing money to local areas for major transport projects, with much more emphasis now on competition for funding. This will not necessarily help regions get a fairer share of transport funding and could make the situation worse. The Government's focus on using competition to bring in private sector funding for projects could disadvantage the regions, where there tends to be less private sector money available compared with London. Those Local Enterprise Partnerships (LEPs) which are well organised and resourced will have an advantage in bidding for funds. Other areas may lose out as a result. In addition, with greater reliance on competitive bidding for funds, there will see more money wasted on failed bids. Strategically significant schemes such as access to ports must not get overlooked. The changes are set against a backdrop where far less money is spent on transport projects outside London than in the capital. Transport infrastructure spending is £2,500 per head in London compared with £5 per head in the north east. This inequality must change. The Committee calls for the new funding arrangements to be reviewed by the end of the next Parliament to ensure that they are efficient and effective in providing funding for the most urgent transport priorities.

The Government's new maritime strategy poses the right questions about UK shipping but does not yet provide compelling answers on a range of key points. In particular, it is unclear how the Government plans to address the looming skills gap whereby the UK will have 5,000 fewer deck and engineering officers than the UK's maritime sector is predicted to require by 2021. The Committee recommends that the Government: make an explicit commitment to address fully a significant looming shortfall in UK trained seafarers partly through the Tonnage Tax, SMaRT funding and apprenticeships; commission an independent review of the MCA to evaluate how far a ongoing budget cuts may weaken the UK's ability to enforce compliance with international shipping regulations, undermine its status as a high-quality flag nation and shrink its influence within the International Maritime Organisation.; review the support the UK provides through its oversight of the Red Ensign Group to a number of competing registries of crown dependencies and UK overseas territories to raise the standards of the vessels which fly under the this flag; implement stronger seamanship qualifications by 2016 for the crew of all transfer vessels taking staff to and from offshore wind farm installations (and to call for voluntary compliance with these higher standards before that deadline); and support London International Shipping Week 2015 but showcase shipping around the country

The Transport Committee says a short-term approach to planning key infrastructure projects has left many estuary areas in the UK with inadequate transport capacity and poor connectivity: "A lack of cross-river capacity limits local and national economic growth so we call upon the Government to take a far more long-term approach when planning new bridges and tunnels. The Government must rectify that weakness as soon as possible. Important infrastructure projects, such as the Mersey Gateway Bridge, have the potential to generate economic growth by linking workers to jobs and consumers to retailers." The Committee welcomes proposals to build a package of new river crossings in east London and believes these developments are "long overdue."

The Department for Transport predicts traffic levels on the SRN to rise by 46% by 2040. The network has suffered from inconsistent funding and changes in Government policy over the past two decades. Road users deserve clarity on how the network can be part of a high quality integrated transport system. If the traffic forecasts are correct, the Government will need to increase investment in the road network substantially during the next decade. This requires new long-term funding streams. A consensus would be required to introduce any road user charging scheme across the SRN and the many issues involved would have to be resolved. The DfT must develop a transparent system of road planning as part of a wider national transport strategy. The DfT's National Transport Model (NTM) should be subject to wider scrutiny and DfT should commission integrated passenger and freight plans for strategic transport routes, rather than looking at one mode of transport in isolation. The Committee is not convinced by the case for establishing the Highways Agency as a Government owned company (GoCo). The benefits seem achievable through better management of the current agency and its relationship with the DfT. If the Highways Agency becomes a GoCo, it will need a strong system of scrutiny. The current proposals for this are inadequate. The new scrutiny body will need the power of a full regulatory authority.

Book excerpt: Last year the European Commission published a staff working document that was principally concerned with extending the Commission's involvement in transport security matters. Land transport security measures seek to prevent acts of unlawful interference against passengers, freight or transport infrastructure in the road and rail sectors. Unlawful interference, as referred to in the Commission's document, includes anything from terrorism to relatively minor crime against passengers and transport operators. The conflation of such wide-ranging security issues is not helpful and the Government is urged to ensure that any future EU land security transport proposals are more focussed. Overall, the current risk-based approach to land transport security in the UK are working well and security measures deployed across UK transport modes are proportionate to the current threats that any given sector is exposed to. However, some weaknesses in the UK's current land transport security regime were identified, including, for example, procedures for dealing with multi-modal transport hubs at which different threat levels are applied to different modes; ensuring that staff had a consistent level of training and an understanding of potential threats, risks and preventative measures; and the difficulty of maintaining a high level of both staff and public vigilance. The principal recommendation is that the Government should participate actively in EU discussions to ensure that any detailed proposals are focussed and appropriate to the UK. Parliament should be keep abreast of developments so that we can continue to contribute to the shaping of policy in this area

However, some of the increase in whiplash claims will have been due to fraud or exaggeration. The Government must tighten up the requirements for motor insurance claims and ensure that insurers honour their commitment to reduce premiums. The Government should consider requiring claimants to provide proof that they have either been seen by a doctor or attended A&E shortly after the accident. The MPs also note that their previous recommendation on making the links between insurers and other parties involved with claims more transparent has been ignored. The absence of comprehensive statistics about road traffic accidents means that it is impossible to relate the increasing number of personal injury claims in recent years to the number of accidents. Data collection about road accidents needs to be improved help to assist detection of fraudulent personal injury claims and help highways authorities improve road safety by targeting spending on accident black-spots. The Committee also supports the proposal for an accreditation scheme for medical practitioners who provide medical reports in relation to whiplash claims. Access to justice could also be impaired by Government proposals to switch whiplash claims between £1,000 and £5,000 to the small claims court, particularly for people who do not feel confident to represent themselves against insurers who will use legal professionals to contest claims. Ways in which use of the small claims track could be combined with the routine submission of expert evidence should be considered

Book excerpt: In this report the Transport Committee reject calls for a new hub airport east of London and urges the expansion of Heathrow where a third runway is long overdue. Building an entirely new hub airport east of London could not be done without huge public investment in new ground transport infrastructure, and there could be a substantial impact on wildlife habitat in the Thames estuary. The viability of an estuary hub airport would also require the closure of Heathrow - a course of action that would have unacceptable consequences. Adding new runways to expand a number of other existing airports will not, on its own, provide a long-term solution to the hub capacity problem. The report also rejects the notion of linking existing airports by high-speed rail to form a split-hub; the outcome from this would be highly uncompetitive in terms of passenger transfer times compared to competitor hubs overseas. Other recommendations cover: compensation for people affected by noise from expansion at Heathrow; a national strategy to improve road and rail access to major UK airports; ensure that the High Speed 2 (HS2) rail network serves Heathrow and develop dedicated rail services to serve Gatwick and Stansted; study how far Air Passenger Duty impacts on the UK economy; carry out an objective analysis of the impacts of introducing differential rates of Air Passenger Duty; promotion of airports in regions outside the south east and introduce an APD tax holiday for a 12-month trial period for new services from them.

Book excerpt: In this report looking at policy for improving road and rail access to ports, the Transport Committee urges the Department for Transport (DfT) to become a keener advocate for UK ports. The Government should contribute to significant improvements to strategic networks which also deliver wider benefits - rather than simply expect port operators to pick up the entire bill for measures required to mitigate increased traffic due to port expansion. If the Government chooses to apply European Commission state aid rules in this area more strictly than other EU countries it should explain why it does so. Policy in this area should be applied consistently across the country. While some ports have contributed towards transport schemes to improve access, others have not and the differences in approach have not been explained or justified. Ports should also continue to contribute to local transport infrastructure improvements, following discussions with relevant local bodies. The Department for Transport should demonstrate whether port master plans have had any impact, highlighting good examples of such plans and of how they have influenced decision makers. Finally, the Government should devise a more effective successor to the Waterborne Freight Grant, to stimulate coastal shipping.

Book excerpt: The use of parking charges and fines specifically to raise revenue by local authorities is neither acceptable nor legal. Annual parking accounts would allow the public to see how much local revenue is derived from the enforcement of fines, and what proportion of this come from on or off street parking charges. It's right that parking charges be determined locally, but hard to justify fines that substantially exceed penalties for more serious offences like speeding. DfT's statutory guidance should stipulate that local authorities implement a 'grace period' of 5 minutes after the expiry of paid-for time on any paid parking before enforcement officers issue a Penalty Charge Notice (PCN). The Guidance should be clarified and updated, particularly in relation to rules for loading and unloading. A 25% penalty charge discount should also be introduced for motorists who pay within 7 days of losing any appeal to a parking tribunal. Local authorities currently offer a 50% discount if motorists pay their penalty charge within 14 days, but this is not available to motorists who appeal to a tribunal. Motorists should also not have to appeal against PCNs where tribunal adjudicators have repeatedly identified a problem such as poor signage. Adjudicators should also be given powers to allow appeals where local authorities fail to follow statutory guidance concerning the use cameras. While businesses cannot be completely exempt from parking restrictions, local authorities must also ensure that the need to restrict parking and manage congestion does not stifle the ability of businesses to trade and help grow the economy

Book excerpt: Implementation of the Government's modernisation programme risks damaging the coastguard. Confusion about the role of the new national Maritime Operations Centre (MOC) and mixed messages about local knowledge and coastguard station closures has undermined staff morale across the service and caused great concern that the vacancy rate for skilled staff has doubled since 2010. There is a worrying lack of information about what coastguards at the MOC will actually do from day to day or how these new staff will work with local coastguards. The MCA's stance in respect of the local knowledge which coastguards in co-ordination centres must have is also confusing and contradictory. The MCA needs to set out its strategy for staff training and articulate its vision of why coastguards in MRCCs need to gain and retain local knowledge. MCA management must schedule and remunerate staff to pursue this expertise, not leave them to organise themselves when they are off duty. The Committee also expresses concern about arrangements for Emergency Towing Vessels and plans for fire fighting at sea now that the Maritime Incident Response group has been withdrawn. The Government is called to provide statistics on the age profile and length of service of coastguards at each MRCC and to set out its strategy for retaining experienced coastguards, particularly in terms of recruitment to positions based at the MOC

The Committee recommends the UK Government should actively negotiate to ensure: joint working between Network Rail and train operators is not prohibited or unduly restricted; metro and light rail systems are not affected by the proposals to separate infrastructure and service operators; the UK's arrangements for letting train franchises are not challenged. In addition, MPs are concerned about: governance arrangements for Eurotunnel; the maximum annual threshold proposed for rail franchises, which could prevent UK companies bidding for work in other EU countries; and the possibility that the EU may become responsible for specifying the content of public transport plans: these should remain the responsibility of national or local governments.
