This book examines in detail to what extent the 1999 Montreal Convention’s aim of uniformity has been achieved. To this end, it scrutinizes the exact scope of this aim and analyses the factors that may have prevented it from being fully achieved. It studies the wording of the treaty and its predecessors, their travaux préparatoires, the judicial decisions of numerous civil and common law jurisdictions, as well as various other interpretative tools. Among many others, themes addressed in this study include: exclusivity; the autonomy of terms used; translation issues; accident; bodily injury; damage; delay; consumer rights; the 1969 Vienna Convention on the Law of Treaties; hermeneutics; the Warsaw System; regional air law (including EU Regulation 261/2004); and algorithms. The study also suggests ways to reduce the fragmentation of the 1999 Montreal Convention with a series of directly applicable recommendations, and an analysis of what Artificial Intelligence could mean for the future. The book begins by looking at the background of China and the history and growth of railway development in China through five key phases, followed by assessing the cultural changes in the railway carriage and exploring how these are linked to social equality and national provisions. The core of this book aims to analyse the Chinese urban transformation through the development of the high-speed rail (HSR) infrastructure in China. Eleven important new HSR stations in mainland China, plus the new Hong Kong West Kowloon Station, have been selected to contextually explore how HSR infrastructures have affected the development of the Chinese urban context. The selected case studies are the stations of Beijing South, Wuhan, Shanghai Hongqiao, Guangzhou South, Xi’an North, Nanjing South, Chengdu East, Tianjin West, Zhengzhou East, Hangzhou East and Hong Kong West Kowloon. All of these were built between 2008 and 2018. In these case studies, the location and the intentions and success of promoting urban development are analysed and assessed. Following this, the book further investigates the peculiarities of the new HSR stations in China in comparison with stations in Europe. An assessment framework is established to evaluate the Chinese case studies comparatively with significant cases in Europe, attending to the urban structure of the area, the architectural quality, the functional diversity and the quality of the public space generated in the surrounding area.

Book excerpt: When Sister Emma and the five women who accompanied her from England crossed the Orange River early in 1874, they exchanged the comfortable mainstream of Anglican Church life for the rigours of pioneering new works in an undeveloped country. Living conditions were primitive, travel was hard, and money was always in short supply. The newly-formed Community of St Michael and All Angels opened the first girls’ schools north of the Orange and the first hospital in the Free State. At Kimberley, Sister Henrietta achieved a world first through her successful campaign for the State Registration of nurses. Four Sisters were besieged in Kimberley during the Anglo-Boer War, and in Bloemfontein their Mother House became a military hospital. By faith and determination the Community recovered. St Michael’s School was raised to new standards of excellence, while the Sisters expanded their mission to include Lesotho and the eastern Free State. Decades of work with Bloemfontein’s sick and deprived led to Sister Enid becoming known as Ma Mohau (Mother of Mercy), and to national acclaim in the 1970s as South Africa’s Mother Teresa. This book studies the development of the Community’s religious life, and charts the progress of their work among all races from their foundation until the death of the last Sister in 2016. Across the Orange, their relative isolation from the strong centres of Anglicanism eventually contributed to their demise, but not before they had established an enduring legacy. The work they began in Lesotho is continued by the Community of the Holy Name, while St Michael’s School in Bloemfontein is recognised as one of the finest girls’ schools in South Africa.
